Transunion's response to MOV

I tried DV'ing a collection agency and received no reply. I sent a mov to transunion and the reply is below. It's basically telling me to do what I told them I already did. What do I do now? Are they in violation?

My letter:

To Whom It May Concern:

I have recently disputed this account and it came back verified:

Collect America Account #1xxx

The only letter I have ever received from this company was an opt out letter threatening to share my information if I did not return the form. I have never received a bill or statement from them. Over the last two months I have sent several certified letters asking for proper validation to which I received no reply. Please send me your proof of verification documents so I can get to the bottom of this problem.

Thank you for contacting TransUnion. Our goal is to maintain complete and accurate information on consumer credit reports. We have provided the information below in response to your request.

Re: Verification Documents not Available

We store information in our records as it is supplied to us by creditors. When information is disputed, we are required to investigate and record the current status of the information. We do not provide dispute verfication responses received from creditors. If you need to obtain documentation or written verification concerning your accounts, then please contact your creditors directly.

The letter TU sent is standard. They simply state that they don't have the documents you're searching for in a paper format, most likely because they don't actually receive anything in writing or at least not on paper.

I would review this site's example of seeking MOV:

The next step seem to be calling the CRA's customer service department and asking a representative point blank for the MOV. Then following up with an additional request to begin a new investigation.

If you follow the same course, just remember take down the name, location, and employee ID info so you can document a complete history of your efforts to seek resolution.

Not only are they required to give you that information, it's FEDERAL LAW! Demand to see the MOV, in writing, or you will be suing them for FCRA violations to get the information you seek.

The FCRA states:

§ 611. Procedure in case of disputed accuracy [15 U.S.C. § 1681i]

(6) Notice of Results of Reinvestigation

(A) In general. A consumer reporting agency shall provide written notice to a

consumer of the results of a reinvestigation under this subsection not later

than 5 business days after the completion of the reinvestigation, by mail or,

if authorized by the consumer for that purpose, by other means available to

the agency.

(B) Contents. As part of, or in addition to, the notice under subparagraph (A), a

consumer reporting agency shall provide to a consumer in writing before

the expiration of the 5-day period referred to in subparagraph (A)

(i) a statement that the reinvestigation is completed;

(ii) a consumer report that is based upon the consumer's file as that file

is revised as a result of the reinvestigation;

(iii) a notice that, if requested by the consumer, a description of the

procedure used to determine the accuracy and completeness of the

information shall be provided to the consumer by the agency,

including the business name and address of any furnisher of

information contacted in connection with such information and the

telephone number of such furnisher, if reasonably available;

(iv) a notice that the consumer has the right to add a statement to the

consumer's file disputing the accuracy or completeness of the

information; and

(v) a notice that the consumer has the right to request under subsection

(d) that the consumer reporting agency furnish notifications under

that subsection.

(7) Description of reinvestigation procedure. A consumer reporting agency shall

provide to a consumer a description referred to in paragraph (6)(B)(iii) by not

later than 15 days after receiving a request from the consumer for that description.

(8) Expedited dispute resolution. If a dispute regarding an item of information in a

consumer's file at a consumer reporting agency is resolved in accordance with

paragraph (5)(A) by the deletion of the disputed information by not later than 3

business days after the date on which the agency receives notice of the dispute

from the consumer in accordance with paragraph (1)(A), then the agency shall

not be required to comply with paragraphs (2), (6), and (7) with respect to that

dispute if the agency

If you send a DV to a CA that was ignored, there is no MOV. A MOV is only valid when you dispute directly with the CRA...since they verify the account.

DV and disputing are two separate things. DV is for the CA, dispute is for the CRA. That's the only time you can request a MOV.

So should I copy the FCRA text and demand the MOV? If they can't furnish it, then what?

Please send me your proof of verification documents so I can get to the bottom of this problem.

This is not a request for a MOV; there are no "verification documents". This is what EX sent me not to long ago:

"The FCRA states that you may:

  • request a description of how we verified the information, including the business name and address contacted and the telephone number if reasonably available;
  • add a statement disputing the accuracy or completeness of the information; and
  • request that we send these results to organizations who have reviewed your credit report in the past two years for employment purposes or six months for any other purpose.

I would specifically ask for the "Method of Verification (MOV)" not "verification documents". Since it was probably done electronically there will be no documents.
