How do I DV Crap One?

Recommended Posts

Shootz—it won't let me change the title—I want it to say "How do I dispute......"

I'm sorry if this is a no brainer obvious redundant question, but I'm not finding my answer clearly in all the stuff on the site and in this forum.

I have OC accounts showing up on my credit report and I want the OC to do an investigation and prove that I signed up for those accounts—show me the apps and stuff I signed. I read somewhere that they don't keep those records and can't prove it, plus I happened to change my name years ago and there is no legal record of that showing up on my CR, so I think I can get these removed because they can't prove they belong to me. The sample letter for this doesn't have the part about providing me with the original documentation of the debt and I know I've seen that somewhere. Does someone know what I'm referring to? And another one of my problems is that I don't have the account numbers for these and my CR doesn't show them completely. The verbiage says it can be considered "frivolous" if you don't have the account numbers. How do I get them if these accounts aren't mine? ;)

Also I'm judgment proof. From what I've read, that only comes into play once/if they actually sue, right?

And should all DV'ing be done via postal registered mail? I read the thread about emailing NCO and how people were emailing. I know you can't email Crap One, but I'm asking for something else that has to do with NCO.

Thanks much!

Welcome. Let me see. First of all, the sample letters are only for guidance and shouldn't be used as is. Your letters should be in your own words and simple. I dispute this account because..... and give the specific reason. I dispute the DOFD, the DOLA, or Date of Status. If you give them specific reasons, other than, it's not mine or no knowledge of account, they are less likely to disregard your dispute. If you use the samples the OC will think you are working w/a credit repair company and discount your dispute as frivolous right off the bat. How do I know? It happened to me when I first started this journey. So, on to the first question.

How do I get them if these accounts aren't mine?

Have you got the hardcopy of each CR? I believe it's TU that will give full account numbers. If not, you should not rely on the online versions. Order all 3 CRs from each CRA. They tend to give you more of the information you need when your trying to clean up your credit.

Also I'm judgment proof

What does this mean? Is the debt outside of the SOL for collection?

And should all DV'ing be done via postal registered mail?

Yes, everything should be done in writing and sent in some fashion that allows for proof of delivery, most common is USPS CMRRR, but there are other options too. If you have a paper trail when it comes to court, you are way better off in defending yourself against the claims brought by the atty's.

I read the thread about emailing NCO and how people were emailing. I know you can't email Crap One, but I'm asking for something else that has to do with NCO.

Have you tried? If it's for GW, why not try. You never know till you try. If it doesn't work, move on to the next tactic. Use all technology available.

Well, I hope I covered all your questions. Good luck.
