question about response to DV letter

I sent out a round of DV letters last week and I today I have received a response on one of the accounts on my girlfriends credit report. This was for a NSF from a credit union, she wrote a check for the last $25 in her account and the credit union denied payment because they had some rule that you had to keep a minimum balance of $25 in your account.

The OC ended up taking $25 from her account as a NSF charge and closed her account then sent her a letter stating she owed $50 to cover the check

She ended up paying the OC for the $50, somehow the OC sent this to a CA after it was already paid.

the CA also shows she owes $191.71 which boggles my mind since the original check was only $50 and change, how it got up to $191 is beyond me.

So I sent a DV letter using the format on this website asking for validation of the debt to the CA on her report and this was the response we received.

we are sending the enclosed for the following reason...

then has a bunch of boxes for them to check off for the reason..

the "other" box is checked and hand written in the space is the following

"we spoke with you in april 06. you refused payment. this was for a NSF check you wrote. if you want any more info you will have to pay the credit union to get it"

this is an attempt to collect debt. any information obtained will be used for that purpose

WTF is that? that is not validation of anything except to validate they are f'n morons

they also enclosed a document, looks to be a fax from healthamerica dated 4/13/06 with the credit union name and address

NSF fee reversals for the 1st quarter 2006

acct# ssn# c/o amount ($125.30) my gf's name and address and phone number

also I just accessed her tri bureau CR and this account does not show as disputed, still showing Account seriously past due(EQ), UNPAID (EX), and manual account (TR)

so, where do i go from here?

First, DV them again, tell them their last reply was not sufficant. If you have proof the debt with the OC is settled I would get in touch with the OC and get things straighted out there.

As to the part I quoted above. A collection account can not be "past due" is it showing up as a collection account? or did they sneek it in as a open account? If so, it's is being reported incorrectly and should be disputed as paid/reported incorrectly I would think.

They are also in violation for not marking their TL disputed. Make sure to print off a copy of the report with the date on it so you can prove this violation if you have to sue.

I don't know about the $25.00, but it looks like they are claiming your girlfriend bounced a check to HealthAmerica. She need to contact them and find out what's going on.

Okay, Ive been reading for a couple of months and finally got the will to move forward with sending out my first round of DVs (all CMRR). I will consistently want my 3 CRs (have TC) but I am wondering if a print out from a TC report will surfice as evidence if the CAs never mark it disputed but verify? Or, do I need an actual real CR in the event I need to prove evidence that they did not mark as "disputed"? Thnx

update on this DV letter.

so like I said my GF said she piad the OC before it went to collections, we get a letter back with a fax dated from 2006 from the CA saying she refused payment to the CA.

so the other day she called the OC and guess what, it WAS PAID long ago.

which mean the CA never went back to the OC for validation, they simply pulled an old fax from their files and sent it as validation.

so meanwhile this was reported on her credit report for the past yr as unpaid and the original amount...$25.00

somebody is gettin another letter, this will say ITS , not validation
