sunshnpd Posted April 30, 2007 Report Share Posted April 30, 2007 I hope I am doing this right...I have been harrassed by Capital One(or their CA's) for about 6 years now.They call my house all hours of the day up to 9:30 at night even on Sunday.I understand that Fla. SOL is 4 years, but Capital One is making sure that all accounts of theirs will remain on my CR for 7 years. I guess because next year will make the 7th year they are really coming at me with both barrells(so to speak).According to Experian they(Cap One) have verified my charged off accounts. This all came about when we had a lot of extra medical expense and I tried to work with them on a payment plan,but they refused to say they would accept it,and kept telling me I had to come up with more. Now it seems they want triple the amount . How can they just keep adding more charges after your account is closed and charged off.Thanks for any help Sun.. If they call you again, sue them.an expired SOl doesn't mean they have to stop trying to collect. They can call you until the day it falls off of the credit report. All the SOL means (when it expires) is that a judge most likely would dismiss the judgement if they tried to sue for the money after it has expired.If the SOL has indeed expired, it doesn't matter how much they keep adding to it, they can't collect. Just ignore them. If you don't recognize the number calling you, don't answer, they can't do anything except call now that the SOL has expired.I know, I just won in court against them. I have put on my ans. mach. that calls are being taped.Most of the time it is a Robot calling, leaving a number for me to call them back.I have sent out 2 DV letters with no reply back as of yet. Southerngirl Posted May 3, 2007 Report Share Posted May 3, 2007 Send them a C&D letter and ask that all coorespondence be in writing. Hopefully that will slow the phone calls down. You may want to let them know that the debt is SOL that might help them understand that you know the law and they can't pull a fast one on you by getting you to pay a debt that is past sol.
