They pulled a hard pull on my credit report and I have NO bills that were not filed with BK7 2 years ago and I don't owe any CA or OC anything - I have not used any credit except my local loan co. since the BK. Period. Noticed the post LadynRed just did re: discharge violations and my BK lawyer is the type to eat them up and spit them out. Are they allowed to pull without contacting me? You can go here: http://gscourt.nashville.gov/portal/page/portal/generalSessions/home/Click on the link to the right that says Court & Dockets and do a search for them. I didn't really pay attention until I got the EQ single and it had the contact info for the inquiry and I realized it was a collection agency. He informed me he was trying to collect on an old Providian account. I told him it was discharged by BK7 over 2 years ago and he got really rude. Said he'd have to run it through their "bankruptcy dept" to see if what I was saying was true. I was pleasant in the extreme! Nauseatingly (sp) pleasant. Gave him my mailing address (PO Box) so they could confirm they fixed the mistake.Here is the letter I wrote going out CMRRR today to their street address.BUFFALOE & ASSOCIATES201 4TH AVENUE NORTHSUITE 1300NASHVILLE, TN 37219To Whom it May Concern:Just had a lovely conversation with Patrick today (05/01/07) at 11:30 am. Since it was long distance for me, I do have a record of the call - just in case you wondered. This is to reiterate our conversation in writing so there won't be any more mistakes that will force me to get my lawyer more actively involved. First of all, just to make sure we follow the law, this was my first contact with your company so I am asking for validation of the debt you are trying to collect. You verbally informed me it was for Providian Bank, but I am sure you must have been mistaken because trying to collect on a debt discharged in bankruptcy 2 years ago would be a violation of the law and since y'all are lawyers, I am sure you wouldn't make an amateur mistake like that. Especially since you pulled a copy of my credit report that shows the bankruptcy right there for you to see. And I didn't even give you permission to do that. OOPS - your bad, so I expect you to make sure that inquiry gets deleted since you had ABSOLUTELY NO CAUSE TO PULL MY CREDIT if you had actually done your job correctly. (And yes, Providian was served with the bankruptcy papers) Secondly, I gave Patrick my mailing address, but just in case he accidently lost it the address is:PO Box xxxanytown, TN xxxxThe only communication I want from your company is to inform me that you have requested a deletion for the inquiry since you screwed up and confirmation that you are NOT trying to collect a debt you have no legal grounds to collect on. I am quite sure that she will set you straight on anything you may have a question on. Actually I would encourage you to call her... I'm sure she will be just as pleasant as Patrick was to me.So now that we have this all straightened out, I look forward to your response. They sued my ex for an old Providian account.I'd report them to the BK Court ASAP. Call the BK Court clerk and let them know about the call. They'll get sanctioned in a pretty major way. That would be utterly pointless. The BK court clerk can't do squat and there can be no sanctions unless her lawyer files a Motion for Contempt against Buffaloe in BK court. Then you go thru the whole process of re-opening the BK case to bring the action and only the BK judge can decide to sanction an offender.Great letter Macwench !!! I wish his lawyer was Ms. Chew-em-a-new-one. lolGreat letter though. My sister is having a collection come after her too that was included in her BK 5 years ago. Might be a distinct possibility.The only lawyer I've seen listed in this area only takes class action suits. We really do need someone to protect the "little guy". With as much as I have seen on this board, I am sure there are millions more cases just like ours.I would prefer an attorney in the event I had to file suit.
