FCRA Violation on Equifax

O.K. here is my question i had a collection account"MCB Collections" back in June 06 that got deleted from my Equifax credit report.All of a sudden April 2007 the same one got put right back on. By law doesn't the consumer reporting agency suppose to notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion. Well if thats the case than shouldn't i have them on a $1000fine. Because i never got a letter from them. Because FCRA 611 section 5 (B)(ii) clearly states, Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency.I still have the delete letter from Equifax back in June 06.And a current copy of my Equifax report with the same account back on there.

So my question is can i sue their a$$ in small claims court and win a $1000. Any advice would be great. Thanks

unfortunately u cant prove a negative..theyll claim they sent it..prove otherwise
