"Sworn Denial"

Recommended Posts

Does anyone know how to write a "Sworn Denial" ( or have a sample) that has to be typed, signed, notorized, and filed in court? This is done to eliminate the Sworn Affidavit of Account, that is signed by the creditor (and notorized) that the debtor owes the debt and the amount. The person who signed the Affidavit is from Georgia and I live in Pa. This sworn affidavit was included in the summons I received for lawsuit. (Cap One)

I am not that familiar with the sworn denial but I would make sure you know what you are doing before you send one. I have read on quite a few boards and from some supposed attorneys that you actually can be perjuring yourself. Again, I do not know but I have seen enough controversy out there to warn you to just make sure you do your research so you don't get yourself into more trouble. Maybe someone else here might be able to chime in. At any rate good luck!

Where is a good place to research "Sworn Denials?" I have searched here, but there is not a lot said......if it helped their case or if it hindered the outcome of their case. I can't afford a lawyer so I am trying to learn as much as I can here. Thanks

I used it... I am waiting for trial....

Do you think there will be a trial or do you think it will be dismissed? (because of the sworn denial) Can you tell me more about the sworn denial? Were you sued for CC debt? Were you served papers? Did you answer the summons and file a sworn denial the same day? Sorry for so many questions but I'm not sure what to do. THANKS
