tdhssbn
Ok, here is my saga now. I filed a BK13 in Mar of 2002 to save my house. I subsequently sold the house in May of 2004 and the BK13 was dismissed at this time. Here is my issue. First Horizon Home Loan was the mortgage company and they are reporting me as a WAGE EARNER PLAN even though the house was PAID IN FULL as of May 2004. Can they legally do this? momof5
Does it show paid $0 balance? If so, yes, they can.
tdhssbn
It says $0 balance, yes. My point is that this account was PAID IN FULL. When the house was sold in May of 2004, the mortgage company was PAID IN FULL. How can they report me as a WAGE EARNER PLAN when they were PAID IN FULL? Just wondering if this is legal for the OC to do.
direred
Because that was the status when you paid in full?I don't know this for sure, but it's a guess.
LadynRed
That notation of 'wage earner plan' is probably the CRA's version of 'included in bankruptcy' - which your house WAS, regardless of whether you paid it off or not. However, if they are trying to indicate that you are STILL in bankruptcy, that would be incorrect.
direred
I searched the Metro2 manual. While one removes a chargeoff notation if something's paid in full, it doesn't seem to require that if something is paid in full after being IIB.Personally, I'd check with one of the attorneys who specialize in post-BK credit reporting cases. tdhssbn
The exact remark is "MAKING PAYMENTS ON WAGE EARNER PLAN". I don't see how they can put that remark in there since I PAID IT IN FULL.
LNY
I thought "wage earner plan" was just CRA verbiage for Chapter 13.
tdhssbn
That might be so. I am not "challenging" anyone on here, please forgive me if that is how I am coming off. I just want to understand how if I Paid it in full, how can they continue to list it as "making payments under wage earner plan". I am NOT making payments, it is PAID OFF. Should the status not read, "PAID IN FULL"?
