I'm dead, should I be concerned?

My first post here.

I've had credit problems all stemming from an episode in 2001. I have one outstanding credit card debt from this time, about $5000 from Providian, which was charged off in 2002.

The debt holder on my credit report I pulled recently is Presidio/CM, and has been for some time now. But on the transline for this debrt on my EQ report it shows that as of 10/2006 they entered "CONSUMER DECEASED." Now EQ itself does not consider me dead, only Presidio. Presidio has not changed the transline for EX, which still reflects this debt, however TU has now erased the transline alltogether. Very weird.

What I am wondering is has this happened to anyone else? And what does this mean, good or bad?

Also, I am wondering when the SOL is really up. I live in Ohio so God knows, but I would at least like to get the beginning date to track it. My last payment was in 6/2001. However, EQ has the Date Major Delinquency First Reported is 11/2003. How does this get fixed?

I'd say Good to be alive, bad to be dead.

There has been some discussion about the SOL for cc debt. Some say that a cc is considered written contract and some say it's not, worse case scenario is 15 years. Best case, it's SOL on collection expires in July 2007 and SOL for reporting in late 2008 or early 2009. It all depends on the way Ohio interprets cc debt. Experts w/knowledge on cc debt in Ohio will surely chime in soon. Good luck.

Ordinarily, yes. Since it's reported by a CRA, no.

Yes, you should be worried about being reported as deceased, though it will prevent people from coming after you for $. ;)

I wonder how many CAs close accounts for good once getting a notice of being deceased? That could be a great credit repair tool.

Have yourself declared dead on your CR. If any of the "estate CAs" write letters, have someone respond saying there's no estate. Based on limited 2nd hand experience, they don't come after you too much longer once that starts to circulate.

Sit on that for about a year, then work with the CRAs to declare yourself not dead. By then, the paper for your accounts will probably be in some sealed vault somewhere, never to be seen again.

I bet they won't even respond to CRA disputes on deceased accounts.

I'm thinking this dead thing may be in the "let sleeping dogs lie" category at least for awhile. I don't know, however, how to fix the Date Major Delinquincy First Reported date though, without tipping Providian off that I am in fact drawing breath and consuming nutrients.
