gagirl02 Posted May 5, 2007 Report Share Posted May 5, 2007 I had a mastercard back in 2000...out of the blue two months ago I received a phone call from S&A and just didn't return there calls....last week I receive a letter from S&A via FedEx saying I had 10 days to set up payments or they will forward to an attorney who will file suit. I immediately sent off the next day a request for validation and I called them...the lady was very nice to me at first but as I kept questioning this debt she got nastier and nastier and she kept calling me "honey"...I said I don't work I don't have money to pay you 700 a month! I then asked her for contact info for the OC and she said they don't have that information...I proceeded to then ask about a SOL she said my last payment was in sep 2001 (the first lady I talked to in March said Jun 2001) so contradicting....anyway--I said well I will talk to a lawyer then...she said "well, maybe your lawyer can help you repay it honey!" then HUNG UP on me!! how real are these people? should I contact a lawyer? what type of lawyer do you need for these things?thanks! Don't worry about when they put things on your reports; they have to provide the date of 1st delinquency to the CRAs. That means this is close to falling off. Most CAs will report monthly so it looks like it's newer, but just ignore that.Of course, don't call them! They probably have no idea when you made your last payment! With that being said, hope that IF they can provide any validation, including last payment that it is June of 2001 or earlier. First of all, you don't request validation from the OC. Second, it's in the FCRA that the CA provides validation. Again, I hope you send your validation request CMRRR. The only card the CAs have to play is "we're going to sue" hoping you get scared and pay them. Don't fall for it; most CAs never sue, because why spend time on someone who's fighting them?
