btrcup1 Posted May 6, 2007 Report Share Posted May 6, 2007 Hi All,I need advice on how to handle a CA....a.k.a. - Accept Acceptance.This CA has called me for several years. I have listened to them, explained to them and ignored them. They continue to call.Now to my point. This debt originated from a CC 14 years ago. I am ashamed to say that I do not know when the last payment was made to the CC. I am almost sure that the last payment I sent was more then 10 years ago though. I know that I have never sent a payment to Accept Acceptance regarding this debt. The debt does not show up as a "potential negative" on my CR but I have noticed that over the past few years Accept has "request viewed" my report for collection purposes.I read from the home page that once it is gone from your report and the SOL is up, not to worry about the debt.Since, I am not 100% sure of the last payment to the CC, and it does not show up as a potential negative on my CR, how can I obtain or prove that the SOL has been met without stirring the pot? So I can tell Accept to stop bugging me about this. By the way, I live in Michigan and I believe the SOL is 10 years. Ahntara Posted May 6, 2007 Report Share Posted May 6, 2007 You must make your request in writing. A 'Cease & Desist' letter would work, so would a request for validation. Or you can just keep things simple and write "I dispute this debt" in purple crayon and return it to them.They are just working old paper. If they are successful, it's a nice payoff for a small investment. But if you make waves, they usually fold quite easily on time-barred debts. Watch your CR for signs of re-aging just in case... willingtocope Posted May 6, 2007 Report Share Posted May 6, 2007 The bad news is, even if it is beyond the SOL, they can continue to attempt to collect the debt. The only thing SOL does is give you an affirmative defense (if you use it) against a law suit in court. (There are some "enlightend" state where SOL also include a "statue of repose" which means the debt goes away completely. MI isn't one of them).Personally, if they continue to call, I'd have fun with it...ask all kinds of questions, play dumb, take down information, put them on hold while you go agrue (loudly) with your next door neighbor about where they leave their garbage cans, break the connnection in the middle of a sentence...see how long you can keep them on the phone. To those people, time is indeed money, and if they're willing to waste time trying to collect an SOL debt, the least you can do is help them.
