Associated Recovery Systems, what to do with them.

I recieved a letter from ARS dated March 26th saying that they were collectin on behalf of Midland Funding who bought out Emerge Mastercard. I DV'd them within the first thirty days and received a list of payments, purchase finance charges and over the limit and late fees. All totaling less than $500. They tell me that my balance with emerge was 1598.90 and all together I owe them 1998.62. I send them a letter asking again for proper validation, they send the SAME EXACT paper back to me. I sent back another letter giving them one last chance.

Well, they didn't offer to validate or even respond to it. Instead they send me a Tax Season Offer which I got in the mail today. They wanted to let me know that they'll settle the account for 1598.90 and consider it paid in full with no further obligation due. They'll settle for the amount that I originally owed before their fees and interest? No thanks.

I'm thinking about sending them a letter saying I'll see you in court, but I'm not sure what I should do. Any suggestions? Anyone else had to deal with these pains before?

Sorry it's so long........just so frustrated.

Is it out of SOL for your state?

SOL or not, you've got enough right there to offset what they're trying to extort from you. Don't back down from this one. See if you can find a NACA lawyer in Indiana who will take a slam-dunk case.

It was on my report as midland credit, not anymore. ARS hasn't listed on my reports yet. I just wanted them to validate it since I never applied for a emerge mastercard. I think my FNB omaha card got bought out or something. Plus it shows a payment in july of 2005, but I started making payments in June of 06 to simm associates.

I have recently dealt with ARS, the were (beleive it or not) helpful, accepted my settlement offer and mailed it to me in writing, received in the mail the day they said it would be there.

Maybe I was lucky on this one?

I got 50% off I know I "probably" could have gotten more but that is at least more like what I owed them, and I am happy to be done with it. I was not paying all those penaltys and interest that makes a 1000 limit show 3000.

I could not get a pfd, maybe you can ( I hope). I would try for the min you can get. My thing was that I was willing to pay what I owed at the time I let it go 30-60 days late. I was not paying all that other S%$t. I had a card I let go that had a 1000 limit showing 3300 balance. That is RIDICULOUS, it has since fallen off. In that cards case I would have been willing to pay 1000, but you should be able to get it for even less.
