ps7psp9
I tried dealing with these dirt dobbers over the phone about the removing the AT&t account which Palisades brought and Mitchell N Kay representing them. I told them this account was 10 years old and the SOL in Florida is 4 years old and that the date of last activity 2003 is wrong. They were like we still can collect... you want be able to get a car, or a mortgage. I had this account in 1996 and it charged off in 1997.So I took the next step in calling the OC and of course I wouldn't have the account number, so I had to give them my SSN, and I was transferred to AT&T collections...look me up and said I don't owe anything. I told her about Palisades trying to collect on an account over 7 years old. So she asked me the number to the agency and put me on hold, and I gave it to her. She put me on hold. Shortly, she returned and told me she called the old AT&T and she said they will recall the account and in 15 days it will no longer be on my credit report. So I will wait and see...sounds promising.Ni Ni
elyse449
I will really keep my fingers crossed. Palisades is a nasty company. Also, if it's beyond 7 yrs they can't legally report. So, while they can attempt to collect until their faces turn BLUE, that doesn't mean they can REPORT until then! Losers!! So, if the acct CO in 1997 AND they've been reporting the additional 3 yrs, you have them on a violation of SOME sort, I'm sure! At any rate, I hope it just comes off your CR's.Elyse
CarolinaBlueEyes
I have the same issue with Palasaides and whats so funny is I NEVER had an ATT&T account... they sent me over to Mitchell Kay bottom feeder... I sent them a FOAD several months ago and never heard back.. I then disputed it with the CR.. it took three times with experian to get it off my report (kept coming back verfied which is a neat trick since AGAIN never had an account with them).. it was finally dropped

If they are reporting to credit dispute it and if they validate it, then it's time to get nasty and think about legal action.
unusualsuspect
Mitchell N Kay is one of the worst ones out there... I am in the process of suing him... I don't think he's even going to appear.DV them and they will go away... but then about 90 days later they'll send a brand new Dunn.
EdwinRamos
That law firm just sent me me a 40% offer on an old CC account, which isn't even listed on any of my credit reports, and I can only guess SOL has expired on. I just sent them a simple DV, in hopes they will offer something less than the current 40% (finger's toes crossed).

EdwinRamos
Well, it never really goes away, in time, it will come back again, and again, so why not just settle it, and get rid of it once and for all...
SecretAgentWoman
Settling for less than the full amount will not accomplish that purpose, because they will just sell the unpaid portion of the debt to someone else.
unusualsuspect
Again don't give MNK any ammo by paying...It's probable that once you pay for this "settlement" you may reset the SOL. Then they will come after you all over again. Don't even bother paying him. JDBs and bottom feeders love people who pay beyond the SOL.
EdwinRamos
If they are requesting a settlement, and it reads settlement in full to the outstanding balance, wouldn't that mean they are settling the matter at hand for less as a full settlement as to what is due?? And yes the issuance of a 1099c at the end of the year....
unusualsuspect
NEVER trust a collection agency's offer to settle. Their forms are often filled with loopholes and outs working to THEIR advantage. Also they could come back and put a new paid collection on your report and kill your credit score. If your debt is outside the SOL, then don't bother paying. Spend your money on something else.

EdwinRamos
Thanks for the input, I will see if they even reply to my DV, since I noticed other's here have posted about being contacted on out of SOL accounts from CA's and were advised to just send a simple DV to end it.Honestly, I don't even recall the account in question, and as I related, it doesn't even appear on any of my recent credit reports, hopefully I won't hear from them again...Thanks once again... divemedic
I certainly wouldn't pay. Instead, you catch them in violations and then sue them into writing you a check for a couple of thousand or more. The reason they pull these illegal tactics is because they know that far more people pay than sue.

EdwinRamos
Well just noticed the track# from the DV I sent them reads an attempt was made to deliver, it looks like they aren't going to accept it, if the DV returns, should I follow with a C&D, most likely they won't accept it as well. And should I follow up on this one by making a complaint to the Federal Trade Comminssion ? after all their dunning letter relates if you request Verification you may do so in 30 days blah, blah, blah... and they aren't even accepting the letter, maybe a violation ? merkurfan
it might be coming back undeliverable. Are you sure you had a good address? they like to move around alot. Sometimes you need a skip tracer to find the CA.

EdwinRamos
Well the letter has two address's one is at, 7 Penn Plaza-18th Floor, New York, NY 10001 where I sent the DV to certified, the other is a PO Box 9006, Smithtown, NY 11787, letter doesn't indicate what address to send correspondance too, but, indicates the Penn Plaza location is for payments, and remember, this one is way out of sol as I indicated earlier.Funny how it indicates where to send payments, but nothing about correspondance, and yet the standard 30 days for Verification on their letter...Well it shows the Penn Address as DOS Process, No Registered Agent, but also shpws ***INACTIVE***See C/P BelowSelected Entity Name: MITCHELL N. EdwinRamos
OK we all know this is a Clown firm and doesn't play fair, as many other's as well, but, what's my best option here, the letter is regarding a debt that isn't presently listed on my CR and most likely if it was fell sometime ago, personally I have No Knowledge of the debt mentioned in the letter, the letter is requesting a settlement at 40% a value, I don't even have knowledge of, I sent a DV letter to their payment address, it appears it isn't going anywhere, it has a contact number, I will not even consider calling, whats the odds, of this clown firm putting some sort of judgement against me regarding this debt and stating I didn't request the Verification allowed within 30 days and therefore am admitting this debt is mine.Maybe contact the AG's Office at this point, with a formal complaint, or wait this one out and see what developes ??
