sexy27 Posted May 9, 2007 Report Share Posted May 9, 2007 I had EXP verify w/i 2 days, shows what they actually "investigated". lol My DV letter arrived at the same time, so how much time should i let go by, before i request verfication/DV(OC) a second time. i dont want to do it to soon and get labeled frivolous. derekpritchard Posted May 9, 2007 Report Share Posted May 9, 2007 well, i always gave about 35 days, 30 days to respond and 5 days mail time once they received it. i beleive if it's timely they can stall and get up to 60 days before you can really do anything. the bottom line is that if you ever need to send them an ITS letter and take them to court, you need to show that you were actively doing something about the matter and trying to resolve it in a timely fashion. their non-response only works in your favor. as far as "frivolous" goes, make sure you state in your 2nd letter that it is a "follow-up" to your first. don't act as if you never contacted them. make sure in the letter to say "I sent you a CMRR letter on xxxxx and it was received on xxx. I never received any communication back from you and I gave you ample time to respond. Pleas keep in mind that I am requesting validation of this debt as per my rights and i expect that you handle your responsiblity." Something to that degree. Sound upset that they are ignoring you and hurt that they are impacting your lifestyle. Besides if you ever have to go to court, again, effort is shown on your side and that's always a good thing!P.S. Keep this thread up to date with your progress, it's important to do that so other new people of even older ones can see what is working nowadays. thanks! Im hot off the handle, so 60 days is too long??I know that Experian sends out some kind of letter usually a few days after your dispute but it's usually not a "investigation". You should get something from them within 30-45 days. I can't see how they could validate within 2 days as they could have not researched it that quickly. Since you have the letter, I would call them and ask specifically about the letter. I don't believe the letter states that the debt is verified...not that quick! They have to send you a letter when the debt is actually verified. If you are still not satisfied after getting that letter, you could ask them their "MOV", method of verification....the who, when, why and how they verified the debt!
