W&A is not the first collection firm to try that "we're immune from FDCPA suits stemming from our conduct during an ongoing case" and lose.

Still, the more case cites the better.

The most important thing coming out of cases like this is the fact that it's becoming harder for CA to get MSJ and dismissals granted. Far too many otherwise good cases have been lost because the CA was able to wrangle a dismissal out of the lower court.
