Drew
I've been trying to get a response on this for some time now. What does it mean to me legally if I never actually made a payment on a CO account?
merkurfan
That you defulted faster than most. It's still a debt, they can still go after you and your still bound by the original card holder agreement.

momof5
You still ask for whatever payment history they have (which is none). But, they may think, UhOH! Better delete! (wishful thinking, but it happens sometimes....YMMV)
Drew
Good point, should I begin with no recollection of the account?
CleverCynic
"history" is just a recollection of previous facts. The history will be that you never made a payment. I don't think there will be any difference at all in the collections and reporting process.
Drew
I meant having no "recollection" as in "unawareness".
docbrotherman
There are many things you can do. Have you disputed and demanded proof of debt within UCC guidelines yet? One needs to study and understand their States' Administrative Proceedures Act and use it to kick 'em, or be kicked. Your choice.

Your choice.Um, yes, I am in the process of disputing the debt and requesting for an investigation. As far as the Administrative Procedures Act, I can't find anything that may be relevant to my case. Am I missing something?
CleverCynic
oh, I wasn't using "recollection" because of the dispute reason, I was just using it as recollection= to recall or retell.
IHateCAs
That you defulted faster than most. This is the 100% correct answer.OP, I think you are too caught up in trying to get hyper technical.
Drew
It was just a thought that occured to me. I thought making a payment would be more proof of ownership.
merkurfan
using the card is proof enough. You can still use the ways we attack OC's and CA's.. make them prove things. you can disupte with a O/C and make them prove it.

I'll see what I come up with.I'm hoping I'll finally see some results out of this.
