So I left HSBC a message the other day asking for a copy of my contract because I did not believe the account belonged to me and they sent this letter.

"We have received your recent phone call request concerning the acount blah blah blah.

At this time we are reporting your household account to the credit bureaus as follows: Account was sold to Collect America you will need to contact them...blah blah

In response to your recent credit bureau dispute regarding the ownership of the account referenced above, you will find a copy of your online payment made to hsbc."

It is a printout from their computer with my name and bank account information. My question...

Does this satisfy an investigation or prove that I opened the account? Does paying a bill establish ownership? How do I respond? Obviously they don't have the information I am seeking.

Did you make the payment on the account that their records indicate?

I'll take that as a yes ( you did make the payments) :-)

Also, the charges you made on the card.

Why are you so oppossed to paying it?

Is there anyone here who knows the answer to my question and is willing to answer it? I can't pay these people because they have sold the account, its reporting as zero and they won't take it back. I can't get any of the 3 collection agencies it has been passed off to, to validate. I'm not trying to wiggle out of debt, I'm trying to improve my credit score. If they can't prove I originally opened the account, why should they and 3 CA's be allowed to report it?

Catch me up on where you are with this. Are you saying that all three CA's and the original creditor have verified to the CRA after dispute?

In response to your question regarding OC proof of ownership, in most states, if the OC can prove that *you* made a payment then they have established that you accepted responsibility (ownership) of the underlying debt.

They charge it off and sell it to a CA. They can now legally report a closed/charged off acct with a 0 balance. They must legally provide the proof of ownership to the CA along with the DOFD.

The frustrating thing with credit repair is that there *are* times where the OC and the CA comply with the law. When their reporting *is* accurate, there is nothing you can do besides a general dispute in hope that it will get deleted.

I have one CA listing a debt. They provided FULL validation. Their listing IS accurate. It is currently 3.5 yrs+ in age and I am waiting for SOL to expire before I continue attempts to get rid of this...like PFD. (When SOL has expired, you have a stronger position in negotiating a PFD....they can't win in a lawsuit so the only way they will get paid is to agree to delete for PIF.)

Sometimes, you just have to wait until it has aged off.

Somewhat callow despite an ideal outlook. Not only is there a wealth of instruction on wiggle room, there's step by steps on how to capitalize on single mistakes in the pursuit of legitimate debts, and we haven't even scratched the surface of FOAD letter tips.

The forum is what you make of it, but in no case does anyone come here to feel worse about their situation. :-)

Yes repeatedly. So far all I've received from anyone is a single printout of an online payment in response to a phonecall after receiving a bogus "investigation complete" letter from hsbc.

Sometimes, you just have to wait until it has aged off.

This one is from when my husband got laid off in the summer of 2005. It's one of two debts I incurred during that time and because of them my scores are tanked. Every time they pass to a new collection agency the scores go down. They were joint accounts so my dh's score really reflects it. He was 2 points from 600 on EQ before midland got ahold of it and started reporting it as a new revolving account now hes back down in the 520's.

Sorry I was snotty in my last post. I'm just getting so frustrated because I keep hitting brick walls.
