I think Portfolio Recovery Hanged Themselves

I'm in the process of getting may paperwork together for a lawsuit against Portfolio Recovery. Their reply to my second DV request was an affidavit claiming legal purchase of the debt from the OC with first hand knowledge of the account blah...blah...blah. I also have several letters from PR with a date they claim to have purchased the debt from the OC. Funny thing is..... I also have a few letters from the previous CA showing that they in fact are the ones who purchased the debt from the OC dated almost a year earlier. Sort of shoots some holes in PR's claims huh?

They have pulled my Credit report twice without my authorization, all for a 1998 debt, as the reason it says on my Credit report "Debt Collection" isnt this illegal? the SOL is up and they are still trying to hurt my credit! Can I do anything?

uh oh, now I'm worrying... I just got a notice for a out of SOL collection (that I think I even paid a long time ago!) from Portfolio Recovery... I hope they don't start slamming me with inquiries and whatnot.

They pulled mine nov 06, and again today, I called them and "went off" Told them the SOL and reporting time was up and they were just trying to keep hurting my credit, and that was against the FCRA and This phone call was being recorded and it was my ITS. They said they have the right to pull my credit report, They didnt care it was being recorded,they been doing this 20 something years they know what is and isnt illegal, and hung up on me....

Be sure to cite the SOL to them and document it viaCRR and keep good notes and DO document whom you have talked too, very important......Good luck! Don'T forget to tell them the call is being recorded in the future?!?

I'm thinking my next step should be a letter to them, and to TU.(the only one they are pulling) I again will state the facts about the SOL and the Reporting time limit in both and the fact they are just trying to keep hurting my credit. Should I send an ITS? Or any thing else or a letter to anyone else?

collections is still a premissiable reason to pull credit regarless of the age of the debt. (unless your in one of the 3 magic SOL states, where once SOL is up, the CA is SOL on collecting) They just can't report. I however am not sure if a hard pull is allowed (softs are hidden and not part of the scoring system).

If the SOL and reporting times are up.They have been told many times I really dont think its my debt and I will NOT pay it. So collection will not happen (and they know this). What would be a legit business reason to pull my report? The only reason at all I can think of is to try "blackmailing" me to pay it. Hurt my credit score and try to keep the debt on my report after the reporting time is up. I can see this, am I wrong? Will a Judge or the Attorney General see it? I think they will, but I may sound like a :oops:dummy. I dont care to sue, but I want them to stop this "unfair" act.

Besides pulling your CR have they sent you any dunning letters? I just found that they pulled my CR on the 30th of May (Thanks TU for NOT alerting me) I have no idea what these clowns are looking for, I haven't be delinquent in years now. <shrug> I hope you stick it to these jerks.

No letters, but I did get a call the day before. I told him the SOL was up. The guy must have thought I was a idiot, he said that meant they couldnt take legal action, but I should make a payment so they could report it to the CRA...I just hung up on him.
