I have requested verification and the collection agency has not responded to any of my letters. I was considering the next step and taking them to court but first I want to make sure I have this right.I reviewed my experian report and it did not have a "collection listing" for this account but there is a "charge off" listing there from CITI. Since the collection agency did not provide verification of this debt will this end up removing the "charge off listing" from citi, or is the method of verification with collection agencys only intended to remove a collection listing account?If it is the latter, is there anything to do about the original "charge off" listing ?Thanks much for your expertise!Z. thomassl Posted May 22, 2007 Report Share Posted May 22, 2007 You will first need to know who owns the debt. Does the original creditor or the collection agency? Sometimes the original creditor will use their own collection agency. Also, the collection agency does not have to respond to your DV. Did you dispute it with the credit bureaus? If you did it at the same time you DV'd the collection agency, they would have to verify the debt or it has to be removed. In regards to charge-off, most times the only way to get them removed is to pay them off with the written contingency that it be removed from your credit report. You are no where near a "law suit" though. You need to read this forum a LOT more. You need to get a collection of violations on them to make a strong case. You must dispute with the CRA. There are many steps you need to consider before walking into court where you would likely be eaten up. I'm not trying to be negative but you truely need to have a better understanding of the dispute / validation process before you try to sue. A suggestion, dispute with the CRA's now since the CA hasn't responded. If they validate, then send another letter to the CA and tell them that they refused to answer you letter so you disputed with the CRA and they have verified. You are now demanding proof of the debt and how they verified the account. From there you can continue putting pressure on them and collecting records of your attempt to resolve the issue before you go the court route. BTW, is the TL out of SOL?
