newbie7069 Posted May 21, 2007 Report Share Posted May 21, 2007 Capital One waited nearly a year after the SOL had run on 2 CO accts before sending them to collection. First I got a letter offering settlement straight from Cap One, when I didn't respond I then got a letter from NCO. Last payments on both were 5/2002.I sent NCO a timely DV, and politely pointed out that MS has a Statuate of Repose. Debts originated in TX so I don't know if applies to me or not, but oh well can't hurt to throw it out there. No response to DV. I then get a letter from Northland on the 2nd account, haven't sent out DV yet but its ready.Today I get a letter from Cap One:Thank you for your inquiry regarding your credit card account.In order to research your request, we must have additional information. From the information given, we have been unable to locate an account number. Please write your account number, SS#, and address in the spaces provided below and return this letter along with the enclosed copy of your original cooresspondance to our office in the enclosed envelope.We apologize for any inconvenience that this matter may have caused you. If we may be of any further service, please contact our office....There is no enclosed copy of an original correspondance, even though it says that there is. But I never corresponded with Cap One only NCO. In my DV to NCO I referenced their internal number as well as the Capital One Account Number. It also has no mention anywhere of being an attempt to collect a debt.I remember reading some threads about similar situations, but am having a devil of a time finding them. What should I do now? newbie7069 Posted May 21, 2007 Author Report Share Posted May 21, 2007 I forgot to add that I sent the DV to NCO at the end of March. It's now nearly the end of May. Since there was no response from NCO, I don't know how the timing thing works especially since NCO isn't on my CR. But does the OC get 45+ days to respond?I don't know if it's relevant or not. If you provided them with an account number to begin with, it sounds like they are stalling for time and I would send another letter explaining that they should have that information if they are reporting accurate information to the CRA and if they don't have it, be prepared to be sued!
