do I have enough to sue

I have disputed with GEMB 3 times and they verify but dont validate. They just sent me a letter stating they no longer have that credit info and to

contact Arrow Financial for further assistance. They insist they are the

orig. OCs etc. They just updated to show account charged off/sold and

was 120 days past due. Looking at a small claims case.Have copies of 3

dispute pages and certified letters I mailed them for each dispute.

But thats the point. they are not the OCs. The account was not open with them or by them in 97. They factored the account from OC. Sorry for the confusion.:oops:

Who was the original creditor? GE Money Bank (GEMB) backs an awful lot of cards.

In 91 our card shows Bank-One. We opened it under that account and it was

closed under that account in 94-95. GEMB factored it and claims it was opened by me, in 97, using my maiden name after I had been married almost 6 years. My ID would have reflected my married name.

Looks like they're reporting correctly, as long as it shows sold $0 balance. If it's over 7 years old the thing to do is to dispute with the CRA. Maybe it will fall off.

GEMB is not the OC. Bank one is. Bankone no longer list on my credit report. Account was opened in 91 closed in 94-95. Still with Bankone. GEMB factors

it -claims I opened it with them in 97-has payment recorod etc. They re-aged. Now I have disputet with them 3 times. It comes back verified. I ask

for validation they refuse. Do I have enough to sue in small claims.

3 printed dispute pages -3 certified letters-3 credit reports with info still listed. A letter stating they have no info on that account.88-)

You can sue them for violating FCRA 623(B), as long as you disputed with the CRA's. Hitting GEMB with dispute letters certainly helps your case.

:)++ Will hold my horses and gather more info to go after them.

some of my proof is I have the orig credit cards from 91 and it clearly

states Bankone as the creditor. My mother opened her best buy account in 96-97 and its still under Bankone. Bestbuy is NOW under HSBC.

just looked at my last dispute letter to TU and EQ. EX would not let me

re-dispute it again. They verified it on EQ. Still waiting for TU which is due 6-6-07. Will keep in touch. Should I write EX with my new dispute reason???

And when I mean verified I mean for timeline re-aging and OC not listing anymore.

yes they GEMB bought it from Bankone in 97. They list it as opened in 97.

The card was orig. Bankone. We just found an old 98 citi finacial contract

(consolidation loan) that list Bestbuy as being pd in 98 under that contract.

they probley sent the check to BOne since thats who we dealt with on the

bill. Bank one does not list on our CR. We had never heard of Arrow until they

tried to sue us
