jrbauto1 Posted June 7, 2007 Report Share Posted June 7, 2007 In 2005 I was involved in a car accident. A doctor bill went un paid by the insurance company. In May of 2007 I got a letter from a collection agency regarding this account. I imediately called the office of the original creditor(doctor's office) and inquired about this bill. Sure enough I owe it, it is mine. I had never been sent a bill for this. When I told them that they were illegally reporting me to the collection agency, they agreed to remove it from the collection agency. They wanted me to pay this old bill. I was wondering how I could proceed with this. The bill is 2 years old and I think they screewed up. I do not have the money to pay the $880.00 bill. What could I do if anything? justincase Posted June 7, 2007 Report Share Posted June 7, 2007 From what you have posted it doesn't sound like they have, if you indeed owe the debt and they are willing to recall it from CA and have it deleted from your credit reports, I would definately make arrangements with them. They have the right to have CA try and collect debt from you, check your States laws to see if it has reached sol for legal recourse, also if the CA is licensed and bonded to collect debts in you State. Sounds like it has reached sol for insurance carrier most of them only go back 1 year from date of service for claims to be submitted and paid. Thats a start, just my opinion. jrbauto1 Posted June 8, 2007 Author Report Share Posted June 8, 2007 They said they were going to recall it from the CA, I do not know if this has been done or not. I sent the ca a request to validate the debt just in case they did not recall it. They went ahead and filed the claim with my insurance but the claim was never paid by the carrier because I was exhausted in my benefits. The problem is that when they got a letter telling them that I was exhausted they never sent me a bill. I only learned about the debt from the ca. Witch brings me to today. The lenght of time from the time they filed the claim till I learned of the debt is about 1 yr and 4 months. I think my best bet is to make payment arrangements. Thanks for your reply. Yea, I would just make arrangement with the OC especially if they are willing to pull it back from CA. If CA reporting on your CR's just dispute it with the CRA's they should delete because your file is no longer with CA. Good Luck!!! Continue to read and research this community everyday. I asked the OC to please send me a bill, and copies of their filing a claim in a timely maner and any denial letters they received if any. No response yet from the oc or both of the ca. justincase Posted June 22, 2007 Report Share Posted June 22, 2007 Well if you have DV'd them within the 30 day window and are in receipt of it, send them a letter advising them they are in violation of fedral laws and to immediately remove account from your CR's and that you will give them 5 days to do so if not file lawsuit on them. The one who is currently in violation is Financial Business Group. I disputed with the CRA's and it got "verified" I have asked for the method of verification since it has not been validated yet. I have my cr witch clearly shows that they are reporting and have in fact "verified" the debt. I will give them about 30 days and then ask them to remove. Or do you think I should do it now? I dv cmrrr on June 2, 2007 they have yet to pick this letter up from the post office. I emailed a dv letter 2 days ago and got a denial of account from them. What do you guys think?? They also sent me a copy of a delete order for the bad reporting on the credit report. ....So for now this medical debt is off my report. I am waiting to hear back from the cra's.
