rillibiig
here's a cliche " I new here and need some help" anyway I've been reading alot about this stratedgy of credit repair, and what I've found is that I dont have a definate lock on wether to send one dispute at a time or multiple ones. does anyone have a for sure answer? also if you do have to do one at a time how long in between does it have to be?I would appreciate any help on ...and ALL the other questions I know I'm gonna have...lol
willingtocope
The rule of thumb is...if there is a possibility that you're going to wind up in court, one way or the other, then send one at a time. In court, its best to present evidence that pertains ONLY to the problem at hand. And, if you're sending them separately, there's no reason not to send them all out on the same day. They'll likely get processed by different rent-a-bodies anyway. On the other hand, if you're only disputing a bunch of semi-related stuff that's not tied to a particular TL, like addresses, there's no reason not to dispute them all at the same time. rillibiig
so correct me if I'm wrong, I CAN send in three disputes the same day on three different things (credit cards)? Also, I've read a little about SOL's but what I'm not getting is,is it 7 years for everyone or is it depending on the state your in? because I saw somewhere on CIC a ledger with the SOL's broken down by states, and each state was a little different on years(ex:creditcards). fatherof3
I too am new here. I love this site. I send all my free time roaming this place. The SOL is listed at the top in blue letters, way up at the top of the page. I had trouble finding it the other night after hours of searching the site. You are not alone, good luck with your fight. willingtocope
Yes, you can send 3 seperate disputes on the same day...in separate envelopes if you might wind up in court, or all in the same envelope if its something trival. As for the your other question...there are two different things. SOL is "statue of limitations" which is a state by state thing that gives you an absolute defense should you be sued. The 7 year rule is "the reporting period" which is federal law regarding how long something negative can stay on your credit reports. Same for everybody. rillibiig
ok thank you for clearing that up! Now...lolwhat if I have a charge off that's not seven years old but in my state the Sol is now in effect on it. can that be disputed?
willingtocope
what if I have a charge off that's not seven years old but in my state the Sol is now in effect on it. can that be disputed? Not really. In all states except those that also have a "statue of repose" (like Wisconsin), even after the SOL and even after the 7 year reporting period, you still owe it, they can still try to collect. The only possible exception to what I just said is if the OC marks your TL with a $0 balance, and issues you a 1099c for the "found income"...on which, the IRS will want you to pay taxes. And even then, its unclear as to whether a junk debt buyer could try to collect....
