I am going to fight the lawsuit, but not sure how! Do I file a motion to dismiss the complaint? Do I file a motion to dismiss summary judgement? I am very lost! Please help! girlfromga Posted June 18, 2007 Report Share Posted June 18, 2007 I'm sorry if I'm posting in the wrong spot. Friday I was here reading and found something I wanted to come back and read again. It was on summary judgement's. It told what to do next if it was granted or denied. Now I can't find it. Could you please give me a run down on this. It is to be read on July 10 and I'd like to be ready to file a response either way it falls. I have put so much time and work into this I don't want to mess up now. Also am I correct in thinking old debt never goes away. They can just keep selling you to who ever forever even after the SOL is long passed. The case I'm working on know is 5 and a half years old on a 4 year SOL. SOL for open accounts and contracts for sale of goods in GA are 4 years while SOL for written contracts is 6 years.
