PayPal

Aloha All,

I am having an issue with PayPal. Here's the story:

Back in Sept 06 I opened a PayPal acct when I was moving to do some selling on EBay. Once I was done I never closed it, but now I am being told there is a balance of 1341.00 on the account, not my transactions.

I was contacted by a collection agency May 6, 2007 (IC Systems) and I DV within the 30 day, I received the green USPS card back, proving that it was received within 30 days.

I then had some more selling to do on EBay and my partner opened a new acct with PayPal before I could say we were having issues with them.

This brings us to June 21. I received an email from PayPal that they had "limited" my account access due to security measures. Bear in mind this is 20 odd days after the collection agency received my DV and they have not responded. I submitted the information they asked for and then received an email that thanked me for sending in that information but before they could review it I would have to pay the negative balance on the other account.

I cited the FDCPA and that account was in dispute, etc, etc. Received another email telling me to pay the balance, and then another. Finally after a fourth email yesterday I am frustrated. I have responded every time citeing the FDCPA. TO me this is collection activity, right? Now from what I understand, while a debt is in dispute, that covers the OC as well, right?

Any suggestions??

I'm not sure about all the other stuff. PayPal can be a real thorn imo.

But, an email from PayPal saying that they've limited your access due to security reasons is a COMMON spam email and you should NEVER email back your information to PayPal. The hackers look for activity on your account, even as little activity as logging in to your account. Then start sending you emails that your password has been changed, your account in limited, fake reciept of your recent "purchases". Just NEVER respond to them and forward them to the PayPal fraud department.

Was your partner a business partner? If so, the debt is for business debt which is not covered under the FDCPA. If this debt was for home, personal use then the FDCPA applies.

I'd look at the transactions to see who won the eBay auctions, and then talk to PayPal if they aren't yours.

Talking to paypal is like reasoning with a mule.

Their account limiting department is so wide and sweeping it is rumored to generate millions for the company. Check out paypalsucks.com for way more information. If you are primarily a buyer, paypal is generally ok, but a large percentage of vendors or regular sellers are bound to get stung eventually.

It's probably too late, but the only real good advice is to NOT submit ANY more personal info like SS# or faxed documents to them for any investigation. It is NOT an investigation, the decision has already been made and that information will be used to ensure you never set up another paypal account.

All you can do is wait the 6 months for any money they have siezed. They have driven people to debt and long-term poverty who have used them as a primary bank account.

The truth is SOOO disturbing and unbelievable that most people believe its overblown and untrue until it happens to them. And I promise I am NO conspiracy theorist or advocate about anything... well other than this.

Thanks for all th advice! It was a personal transactions, so the FDCPA applies, now what to do about it since they have been trying collect?

I had already faxed in docs to them before I read your email, opps! Anyway, you had mentioned six months, do they have to release it then, or can they transfer it to another acct, etc?

They have 180 days, then they refund it by check or deposit, your choice. This is in their TOS agreement that you are forced to agree to (they have a practical monopoly on e-bay business, so yes, forced).

All you can do is refund to customers while you are limited... and of course deposit more into your paypal account.

They have been sued over and over and generally win, and any settlements they may have ever paid are sealed under privacy. There are insufficient laws governing this type of business, and not enough businesses like it to bother legislating. Some day the dam will break, but probably not in time to help you.

Ironically, they are such a monopoly that I again have a paypal account even as much as I hate them, though I had to wait until I moved to do it and only use it to purchase. Flying under the radar so to speak. They track IP for logins as well. I had to forego my refunds 6 months later because I knew even clicking on the e-mail I would lose my new account.

There doesn't have to be any reason that you will ever know that they will limit and close your account, and in your case you're doubly bent because they at least have some shred of a problem to hold on to. But, again, you're not really doubly bent because like I said it makes no difference if you did something or not to them.

I had paypal do this to me. and again on a new account I opened. I just told them to FOAD, their CA too. Sold a wigget, brought 4900 bucks. Guy paypal's the money. Picks it up, off it went. Does a charge back. I have NO prove of shipping (wigget was a 9000lbs piece of construction equiptment) and they grab the funds in my account (all 23 dollars worth :) ) and send ICS after me. I told both them and Paypal to FOAD, the guy still has the equiptment. Signed my as-is where is statement and left happy with the item. He even left GLOWING feedback. I had proof he had picked it up including a copy of his drivers license. Paypal did not care. PAY US is all they could say. I said "see ya in court" They linked that account with my new one and locked that acount with 1 dollar in it too.

I now don't e-bay anything. or use paypal.

Paypal still continues to try and collect after I disputed with the collection agency, via USPS CMRRR. I am getting ready to file a small claims court on violations of the FDCPA.

Am I right to do so, any thoughts, advice?

Paypal is not a collection agency and is not governed by the FDCPA. The CA is the one you have to go after.

All PayPal will send to me is the same email that funds will not be released they are in collection, with IC Systems, who I DVed and that the other acct funds will have to be paid first. I have not received anything about the charges on the other account, so I don't know. The only thing I know is the last time I accessed that account was to transfer money out, at it had a balance of positive $5.00. PayPal will not respond to any of my requests for proof of the debt, and I have not received anything from IC Systems to my DV, nor from PayPal.
