The trustee's argument was rather strange to me though.One one hand he was saying she'll be able to repay because she can make more money due to the advanced degree.But at the same time he said her not trying to obtain work outside of her training was self imposed unemployment as well. She did choose not to work - shoot, when I was broke I used to roll fiberglass at a boat company in the summer, in Florida - talk about hot!!! You do what you have to in order to pay the bills as best you can. Judge felt like she wasn't making that effort so I understand that part. And he did leave the door open to file a chapter 13... although I wonder if she does find work that doesn't pay well if she can request the chapter 7 be reinstated (or if that is even possible). However, it seems fairly specialized and to expect that you'll get a job near home in such a field is probably not very realisitic - unless there's a camp or facility nearby already. On the other hand.. there are many, many people with advanced degrees who cannot get work in their chosen fields and are working at jobs that pay far less than what they could POTENTIALLY make if they could work in their field. Right now, my degree is in Chem/Bio and I never found a job there, even washing lab dishes. Funny, how it works out though. I got a job in my hobby field, computer networking and programming. I DO wonder who that trustee was since my Bankruptcy was also in Wisconsin. My fiance had his too and did a lot of what they described but they didn't dismiss his Bankruptcy. She wouldn't have to work at Target or Walmart or McDonalds. I really doubt her chosen field made much or any more than teaching or showing properties or bookkeeping etc...I doubt she was really counting on this. Probably "great if I get it". You just can't make comfort demands and expect success. Being in debt sucks and it stays that way until you're done.
