Erica.cobb
Hi Everyone, I have been reading the different posts here and I am getting confused. Should I DV a CA before or after the SOL. Correct me if I am wrong, if I DV a CA before the SOL they will sue me? In Texas the SOL is 4 years, most of my accounts are from 2004, should I wait another year before doing a DV. Also, what is the time frame. If it has been well over 30 days since they contact you, should you not do DV?In a post that I have read is said to not DV or dispute before the SOL because you can be sued.Well in another dispute it says you should DV 30 days from the time you recieve the notice which is well before the SOL right?any suggestions? direred
I would only DV within SOL if:1) It's within the first 30 days; or2) You're prepared to pay promptly when they respond.
divemedic
Now, I have and would DV no matter what. They will usually violate. It depends on the specifics, but you are almost always better off sending DV.This is not an exact science. You mileage may vary. Results are atypical. Etc, etc
IHateCAs
There is no clear cut black and white answer to your question. It depends on the circumstances.
IHateCAs
And since you are in Texas, waiting to DV isn't as bad as waiting to DV in another state.
merkurfan
what kicks butt about TX law is a CA MUST awnser your DV. Regarless of how old the debt is.

And also correct it isn't an exact science. The law is clear cut though and violations are grounds for suit or bargaining power.
