douglashicks
I posted this in another section, and thought I might get a little more help here. Sorry for double posting. My credit is horrible...ugly. Ive been reading these boards for awhile, and, Ive been trying to fix my credit one step at a time. I figured Id start with some smaller accounts, to get the ball rolling. I intended to negotiate getting the accounts deleted, if I paid in full.I got a letter in the mail for an account from June 2004. Its for 150$, and Im ready to pay this amount now if I can get it deleted. I realize I need to get it in writing before any money changes hands. ANYWAYS, I called (I know, I know, never call) the people who have the debt right now. They said they havent reported it to the bureaus yet. So, if I pay today, they wont report it, and they'll tell the agency they bought it from, that the account is paid. What does one do in situations like this where the debt has been passed of from one agency to the next...? Is getting it deleted really going to do much good? The OC and the first CA are still going to show as derogatory...correct?
Amerikaner83
So, if I pay today, they wont report it, and they'll tell the agency they bought it from, that the account is paid. That just makes it a PAID COLLECTION for the agency they bought it from. But why would they even tell the agancy they bought it from anything? What does one do in situations like this where the debt has been passed of from one agency to the next...? Is getting it deleted really going to do much good? The OC and the first CA are still going to show as derogatory...correct?Yes that's correct. the OC will show it as CO, and the 1st CA will probably update to PAID collection if the ppl you pay now tells them.I'd get something in writing from this CA that is willing to take your $$ that they NEVER report it to the CRAs, NEVER sell, transfer, or otherwise assign this debt to any other CA, and some sort of NDA to prevent the first CA from knowing you paid it. With this, then couldn't you just tell the fist CA "hey doofus, since you don't own the debt anymore, by law you can't report it anymore...so go bugger off"? hopelesscred
before you pay...get any agreement in writing..if this is a med collection, the OC is not allowed to report due to HIPAA rules. Simply DV them...when they respond...send a settlement agreement where they agree not to report.
bigjohnstud4200
If it's not reported yet, I would record them (if you are both in one party states) and then pay it. If they report it, I would sue them for breach of contract.

So, what do I do about the first CA on my credit report? Also, do I have anything I can do with the original OC? Heres how it all looks on my credit report :http://i21.photobucket.com/albums/b261/XMASTERBATTERSX/BADCHECKCREDITRPT.jpgEDIT : I guess I cant post HTML yet. Anyways, Ive compiled the listings from my credit report (acct numbers excluded) into one JPEG....EDIT #2 : Thanks for the responses!

I would send them a DV and dispute with the CRA's.
PolarBearnCO
Yeah, if the CA that is reporting truely sold the debt, then their debt should soon disappear, on its own or with help of a DV.I recently experienced a similar situation. I owed University of Somewhere $1050. It was being collected by COLLECTOR A for years, but they had no luck getting anything or even contacting me. COLLECTOR B enters the picture. They called me several times in a week saying it was "time-sensitive." I called University of Somewhere and verified COLLECTOR B was who should be collecting. They were. COLLECTOR B told me the same thing... "we haven't reported it yet. If you pay in next 72 hours, the balance of the account will be zero, and our system will not report it. I am in a one-party state, but asked to record them saying that and they refused.. hahaha. Well, I took my chance. I knew I had to pay it or I'd have probably got sued. I paid it over the phone and ... 3 months later, they have still never reported it as a paid collection. COLLECTOR A disappeared from my CRs.So, what they say may be true. Will you get it in writing? I wasn't able to. I took the chance, and what they said was true. Wish I knew how to record a conversation on my cell phone. That's the only phone I have.Good luck. That's the only phone I have.Good luck.Anyone interested in how to record calls on a cell phone or ANY phone, pick up an Olympus Telephone Pick-up http://www.olympus-europa.com/consumer/2587_TP-7_Telephone_Pick-up.htm. I think it was about $10 bucks from Radio Shack. You must have an external recording device, you can pick a digital one up for $20 bucks or so. PolarBearnCO
Medical OCs don't generally report anyway. They let their CAs do that.
