I have been working very hard to change my scores... I am working for a guy in the taxi business and have been for the last six months. One month ago he offer to sell me the business and I accepted, but got nothing in writing. I bought a car to turn into a taxi... I gave it to him to install a meter. (I am under the impression that I am soon to own the business). That night he changes his mind and asks me to continue working for him...I told him that I will be starting my own business and to give me my car back. He hides it in storage this past friday night 7-6 and I call the police. By the way he has only had the car 3 days. The police say it is a civil matter and their hands are tied. He (my old boss) says he is going to place a mechanic's lien on the car monday. I haven't seen anywork that has been done and have no invoice. How can he do this? what can I do to get my car back. I definetly do not want a lien on my credit. I know he is just trying to foil my new business. He is also a retired police officer and knows the law much better than I. Big Time Posted July 9, 2007 Report Share Posted July 9, 2007 He hasn't already done the work to install the meter? He can only get a lein on the car if you refuse or are unable to pay for the work. If he refuses payment or something, I would go swear out a warrant for his arrest for GTA, then I would still sue him for depriving you of the use and enjoyment of the car, as well as lost wages.Make sure you send him certified mail or FedEx with tracking to make your allegations and intentions clear. Retired cop or not, he doesn't actually have more power than you, but it sounds like he is preying on your inexperience like a debt collector would. bigjohnstud4200 Posted July 9, 2007 Report Share Posted July 9, 2007 I'm confused, did you get the car back when you called the police? it is a civil matter regarding the mechnical work, but you have a right to have your car back. Do you know if he's done the work? I would call the police again and retrieve my car. If you see the car and the work is done, you will likely owe it. Recovering Attorney Posted July 9, 2007 Report Share Posted July 9, 2007 he is claimiong a garageman's lien, which says he can keep the car til you pay fo it. Get yourselfl to a lawyer, quickly. Part of his job was to pick up and deliver work, parts, etc. For this purpose, I let him use one of my pickup trucks. One day, I decide that I cannot afford to keep him, so I tell him that he will be laid off in 2 weeks. During that 2 weeks, I tell him that he will continue to work for me, 4 hours a day, but I will pay him for 8. That way, he would have time to find another job.He did not show up for work the next morning. I tried calling, he did not return my calls. After a week, I go over to his house and ask for the truck. He threatens to "bash my teeth in" with a pipe if I ever come back to get it. He tells me the truck is now his. I call the cops, and the sherrif told me that since I gave him the keys it was a civil matter, and that I would have to handle it myself. I asked him what he would do if a deputy acted that way, and he told me that was different.The next morning, I get notice from the DMV that he has initiated a mecaincs lein, and that they would reissue the title to this guy if I did not produce the car within 5 days. I found out where he was working and went over there to get my truck. It would not start, and when I opened the hood, I found that he had taken the distributor wires out. He came out and tried to attack me with a pipe wrench. I pepper sprayed him. His coworkers came out and started threatening me.I got a shotgun out of my other truck (the one I had come in) and asked them who wanted to be a hero. They backed away, and I towed my truck away. I got a visit from the sheriff, and I told him "You told me to handle it." he said he did not approve, but I had broken no laws, so he could not arrest me.There are dirtbags everywhere. I do believe the guy holding your car is gonna have troubles with that lein.Did he have you sign a work order? Did he give you a estimate? He likely wants to use it for his business. If he does not have a signed work order how can he claim you brought the car to him for repairs? If you still have keys for it, do what you can (short of breaking the law) to recover it yourself.
