LeslieR
I have a debt that was charged off by Discover over seven years ago. The charge-off no longer appears on my credit report; however, since it went off, the debt has been passed around to several different collection agencies. Most recently, it was bought in April 07 by a new one. How and when can I get ever get rid of this? Can collection agents continue to try to collect debts that have been charged off? Is it legal for them to continue to make it look like this is an active account? My credit has been cleaned up nicely -- this thing is the only lingering bad item, and the way it appears on my report now, it will be there at least another seven years.Any advice or recommendations? Thank you.
bigjohnstud4200
They can continue to attempt collections efforts FOREVER except for in WI and Missississippi. You can send a C&D and that's about it.

IHateCAs
Yeah But cant the NEW CA just start a new TL and keep it going ???The original 7 years follows the debt. So no, they can't rereport it if its eligibility has expired.
elyse449
I'm w/ ihateca's. If the debt itself is beyond 7 yrs, they're SOL and I don't mean statute of limitations. Sure, they can "attempt to collect" until they're blue in the face, but they can not report on your credit files once the debt reaches that mark. What you need to do, is send them a tersely, yet professionally written letter stating you are aware this debt is beyond 7 yrs of age and should they (or any of their subsidiaries) persist in reporting this debt on your credit files you will take the necessary steps in dealing with them via the legal system. (I never had to go that far, I just submitted complaints to FTC, AG (my state AND theirs), and BBB. That usually did it. Send the letter CMRRR to their street addy, PO addy and whatever OTHER addy you have for them. Once you get that green card, dispute the tradeline w/ the credit bureau's. This is what has helped me in the past. Good luck.Elyse
