Anyways, as I've said in other posts I have a Portfolio Recovery collection on all three reports for $390. (Bogus debt to begin with, meaning US Cell DID charge me for it but they ripped me off). Anyways, these jerks from Portfolio have continually made fraudulant reports to the credit bureaus. For instance, they listed it as an installment account. I disputed with CRA and they fixed it, only then they listed it as Open. I disputed it again, they corrected and are now reporting it as 120+ days LATE as of April '07! Which tanked my Experian score btw. I am in the process of disputing that and I go to myfico.com and see whats there and I find that they are now reporting that the account was opened in May of 03! I didn't even have the ORIGINAL acct with US Cell in May of '03! It wasn't even opened until May of '04! Anyways, I have not DV'd them because I'm a bit afraid of what they'll do next. I have been sort of hoping my disputes with the CRAs would eventually just wipe them off. Apparently thats not going to happen. Anyways, I need to know how to go about handling these a$$holes. Even if in the end it means paying the damn thing. (Don't get me wrong, I don't want to and I shouldn't HAVE to, but if that's what it takes to get it off my report then I will). I know the answer is here somewhere, but I have read so much that it all becomes a blur after a while. Can someone sort of hold my hand on this one? willingtocope Posted July 14, 2007 Report Share Posted July 14, 2007 I'd suggest you skip the DV and go right to the "intent to sue" (ITS). You could even go so far as to get the complaint forms from your local courthouse and write up the papers to include with your letter. Point out to them that not only have the not validated this debt under the FDCPA, but you have evidence in your credit reports that they obviously haven't been even reporting it correctly per the FCRA.Tell them to get the TL off your reports, or you'll be happy to file the papers. I wouldn't even tell them to "get the TL off your reports, or you'll be happy to file the papers." I would demand they remove it from the CRs and you will see them in court. So if you find something that works let me know. The account they are reporting for me is a bogus account. And they have the oc as another ca. They are to added to a growing pile of data, for statistical purposes only. When the FTC gets several tons of correspondence on the same issue, they MAY issue an opinion. But otherwise, no action will be forthcoming."...if that's what it takes to get it off my report..."Paying a collection account gets you a 'paid collection', not removal from your CR. Are there any good examples of an ITS letter on here? What should I sue FOR exactly? On what grounds? I know what they are doing is wrong, but I'm not up on all the terminoligy and the process. Also, if I'm going to mess with them I don't want to do it incorrectly and get into even deeper doo doo. That's what I asked for a little hand holding. I', worried I'm going to screw it up.
