It looks like the company may have tried to re-age once again to 6/03, may have made a payment, can't remember. The debt has not changed hands since this time, I don't think. They've been searching hard for me, and didn't hear anything for 2 years at least other than they were calling my "mom's house" "looking for me" and she told them nothing. They even threatened legal action to my mom, so we have a third party communication. Still wanted to lay low and let SOL come and go. Now they are calling my house since we got a home loan, and they got the phone number somehow. We don't answer the phone and still, no mail. I know better than to talk to these people on the phone. It seems that they are trying to "force me out" somehow. Recently, applied for re-financing and/or new home loan, found out from the mortage company they apparently have re-aged the account to 9/06. There in lies the "rub". if we want to go forward and re-finance the house, or get a new home loan and sell this one, etc, gotta fix this. So, if I sue them for the FDCPA violation, then they'll counter-sue since statute of limitation in my state is 5 years, I would probably have to "admit" the account they claim I have to sue, but if I don't try and clear it up I"m stuck for at least another year laying low before I can re-finance the house. Sorry about being too wordy, but does anybody have any thoughts on my situation? They have not validated the debt & I haven't asked them to, as I am trying to stay under the radar. Tried to get information about one of my wife's SOL Credit Card account from the same OC, they sent it on to the JBD. justincase Posted July 14, 2007 Report Share Posted July 14, 2007 You could send them a C&D letter but use a different address, if they do a hard pull from the CRA's your current address will show up being as though you have been applying for credit lately.
