rickmetal37 Posted July 14, 2007 Report Share Posted July 14, 2007 i know i have received much help from this forum,before.thanks a lot.but i still having like witch hunt with the cc.I was hospitalized for three weeks with a second stroke,(am not writting this,my daughter does it).i was discharged two weeks ago.While a was in hospital i received another summons from the same lawyers firm,scumbags.that sued me before.My daughter called them to let them know i was sick with a stroke,unable to answer any complain,they are rude,stupid and jerks.They had the gut to ask for medical records,what is this?a violation of HIPPA?My daughter was told to send a letter from SS administration,just to see am in SS,i send another before March 2007.by the way.I dont think i can answer.am mentally very confused.My daughter tried to explain the court the situation,but they send the letter back to us saying that I had to sign,how come i am going to sign if hospitalized? i see too much hate,ignorance,indiferency,to the sick or elderly,why?Today i receive a slip for a RRR letter from the plaintiff am afraid to know what they want now.i have a SS check,direct deposit,no properties,a car 9 years old the only way of transportation,i am not driving,am not allowed because i lost vision due to my stroke,why am being harassed so much because the age?i know i have to file for bankruptucy but i cant due to my mental condition,how i face this situation,nobody want to hear like am a criminal.please some advice or words will be nice. rickmetal37 Posted July 16, 2007 Author Report Share Posted July 16, 2007 thanks for your reply,but the more i read in some legal web sites, the more scared i get.the talk about being arrested and confined to jail because you dont answer questions? what about you were out sick vacations etc,for a credit card bill?? what a shame? no wonder there is some many peoples file for bankruptucy.they harass you for a cc bill. LadynRed Posted July 16, 2007 Report Share Posted July 16, 2007 IF you are summoned for a debtor's exam AFTER they have won a judgment against you, and IF you refuse to answer the questions at the debtor's exam, yes, you can be charged with contempt and a bench warrant for your arrest CAN be issued. That doesn't mean it will be nor that anyone will haul you off to jail. Since your only income is SS, they can NOT take any of that money. If you truly have no assets, there is NOTHING for them to take from you. Have your daughter, or some family member, call the court and tell them you are physically unable to appear in court in person and get a letter from your doctor that attests to your mental and physical state. You may have to call this lawyer's office and ask that you be allowed to answer their questions via interrogatories which they can mail to you.
