I called them(I know never call but they offered me a settlement for 125 end of the month special) I declined because I didn't have the money at that time but I did save $100 to get a pfd as they offered me before. I read credit information sites & they say this is the best thing to do is wait to the last day of the month & offer a certain amount. Anyone has any advice. I immediately sent a DV and informed them that they were breaking the law by not notifying me. I also disputed with the CRA. 10 days after they received my DV, I sent another letter telling them that they have not validated the debt and that they were still reporting to the CRA which was another violation. When the disputes came back verified I sent another letter letting them know of the new violations and that they had 10 days to delete. 5 days later, I filed a complaint online with the FTC and mailed a copy to them reminding them I would not go away. About 20 days later they sent me "validation" which was faxed to them from the OC. They left the date on the fax letterhead which indicated that they had just received this information a few days prior. I sent them another letter informing them that they were proving my case for me by including the time stamp of their validation to me and that regardless of what debt they felt I owed, I was not paying and would be filing suit against them. When I got confirmation that they had received that letter, I then filed a complaint with the BBB against them, then mailed that to them with my ITS and a couple of pages of my complaint. About 15 days or so later, I got a heavy package from BBB with a letter from Paragon. The letter was written by Paragon to the BBB and basically said, We have two account against BigJohnStud, however, we have decided to stop collection efforts. Attached is a copy of our request to have the accounts deleted from the CRA's. I then sent a copy of the letter I got from the BBB to Paragon Way that said, if you ever sell/transfer this account to another party I will still sue you for your violations. The thing is on TU the account # is off by a digit, placed for collection 06/2006, and DOFD 05/2003. On EX they have placed for collection 06/2006, DOFD 03/2003, and on EQ the are listed as TX Collect placed for collection 06/2006, DOFD 06/2003.On the "validation" statement they sent, they have date of last payment as 10/2003, they are listed as Paragon Way, placed for collection 07/2006.Where should I proceed from here? In my case, they committed other violations and they figured I was not bluffing. I'm sure they figured the cost to defend it would not be worth it. scottb99 Posted August 11, 2007 Report Share Posted August 11, 2007 I have not yet sent the ITS, I did send a follow up DV on 7/17...no response yet. They are trying to collect on two accounts and have never sent anything on one of them. I am preparing my ITS letter with my new found knowledge of the Texas Finance Code. The whole time they have continued to update with the CRA's. I think I'm gonna have to get ugly with them like bigjohnstud did to get rid of them. They have lost a lot of accounts I have read on another board through the BBB. Funny thing is, they are not even listed as a BBB member, wonder why they worry so much about them?
