bluebelle52 Posted July 17, 2007 Report Share Posted July 17, 2007 I am new here so please be patient with me, I don't know where to start, I received a letter from an attorney which were sending a letter re: portfolio recovery associates, re:chevy chase bank, they say they are going to sue me over a debt that is almost 7 years old, I sent a dv letter per one of your sample letters here, they in turn sent a letter on the attorney's stationary stating when the account was originally opened and when they received last payment and how much I owe them now, and stated that if I don't send the full amount in 15 days they are going to sue.Please help me I am terrified of what is going to happen next,they say they looked at my credit report and that it is their opinion I have the means to pay them off, I don't know where they got their information I can't even get a cell phone my credit is so bad, They ceased my accounts last month and as of now I have nothingI do apologize for going on and on but as I said I need help thanks in advance, bluebelle52:-( Link to comment Share on other sites More sharing options...

Doesn't mean they will. It's not uncommon for CA to look at your credit report.You should get all 3 of your reports and check them over really good. jetscarbie Posted July 17, 2007 Report Share Posted July 17, 2007 You need to check with the local courts and such to see what judgements they have against you. I don't think they can cease your account without going to court first.Check online and see if your local courthouse is online. You might search your name there and you might see where they got a default judgement against you.Maybe someone on here with more knowledge can chime in with some better advice. bluebelle52 Posted July 18, 2007 Author Report Share Posted July 18, 2007 I checked all 3 of my credit reports and this debt was charged off in 1997, I believe from reading this site, that the sol is 6 years in ga, if that is true how can they do what they are doing? the original balance was 7.890.04 it is now almost 12,000. thanks to portifolio. VaSwtness Posted July 18, 2007 Report Share Posted July 18, 2007 Sounds like a judgment. If it was charged off in 1997; the tradeline wouldn't be showing on your CR (or shouldn't) any longer. merkurfan Posted July 18, 2007 Report Share Posted July 18, 2007 They can't sue twice.. So I suspect they have not yet. But as others of said BE SURE they have not already. I don't understand how they could clean out your account at the bank with out a court order of some sort. I'd be checking with your bank and getting copies of the documents they where given. They can sue you on a SOL debt. You must anwser it and use the SOL as your defense. A judge is unlikely to bring it up for you and even though SOL, if you no show/no answer they will still get a judgment.If they have sued and won a judgment they are violating the law (threating legal action they can't take) Link to comment Share on other sites More sharing options...

And I do agree, ask the bank what forms they were given.I'm sorry this is happening. I know how scared you must be, but remember-that's what they WANT!
