Pioneer question

i know that I should know the answer to this question, but I'm passing this on to my parents and I want to make sure that I'm correct with my information.

While visiting them I see a collection letter from Pioneer that is collecting for Sears on my parents table. I ask about it and it appears that my father agreed to let them do an automatic draft for $150 for three months from his account. The third payment will be this month. I told them that they should never give their acct number out, but it is too late. They claim that Pioneer wouldn't take a money order.

Anyway. I told them not to talk to them anymore and to seek validation. I was going to help them with a letter. I know that unfortunately the SOL resets, but there is nothing to do about that. I suggested that they open another account, but I don't think they will go to another bank. Is there really a threat of them pulling more out than they were authorized?

I know that in Texas there is no deadline for requesting validation, so is this still true after a payment is made? I thought I would get them to try to get validation, then settle if possible. Any feedback would be appreciated.

From my understanding as long as they have that bank account information, they can pull any amount of money out. However, depending on your (or theirs I guess) bank you can dispute the charges, and the bank should credit the account and investigate the charges. Each bank has different procedures, I'd have them check with their bank and find out.

I should know this, but I read on another post somewhere here that a partial payment doesn't necessarily restart the SOL clock in Texas. It's the first I've heard of this. Is this correct? I got my father to write Pioneer requesting validation on the account. Ofcoarse he has none of his paperwork from this account. Would it be good for him to contact the OC, through a letter and ask for a record of his account which is in collections. The OC is Sears. I'm not sure how they would handle such a request. Any thoughts?

I don't know for SURE, but I'm pretty sure that partial payments in TX don't restart the SOL. I believe you would have to make a payment large enough to bring the debt out of default in order to restart the SOL. If the account is CO already, no payment amount will ever restart the SOL.

I got my parents to send a validation request to Pioneer and this is what they received...

We received your written dispute regarding the account identified above and we have requested from the creditor the information necessary to resolve your dispute. Unfortunately, we have not had sufficient time to obtain verication of information from the creditor. Until we receive such information, we will note in the file your dispute as requested and we will cease all collection activities on your account. if our client does not provide verification, we close the account in our office.

I'm guessing they won't find anything. Would it be crazy to try to get the $450 my parents paid them or should they just leave it alone and be more careful next time.?

I would just leave it alone, you'd probably have to sue to get it. If you don't hear back in 15 - 30 days, I would send another letter saying, "you need to delete".
