Last year I was contacted by a law firm by letter stating it had the account & if I didn't act in 30 days, they would pursue legal action. I called, spoke to a lawyer & set up a payment plan to pay 2 installments each month to total 1 amount per month. A few weeks later, he called back & said that the payments didn't register through with the system and I had to pay one lump sum, which I agreed to but never paid. I was smart enough to pay by money order, and when I called the company I used for the money order, the payments went through. I still have the receipts. The company's calling again. I never knew about DV before coming to this site, and I believe my rights were violated under FDCPA. This is my 7th year. What action do I take now? I live in NY. hopelesscred Posted July 23, 2007 Report Share Posted July 23, 2007 The statutes of limitation (SOL) in NY is 6 years, I think you were suckered into paying an out of SOL debt. The reporting period should end this year so you can tell them to FOAD. Also you prob spoke to a CA....Next time they call or write, send them a nice FOAD letter with a C&D. Now when I write the letter, do I also send copies of the money orders I sent? Also, how long is it before it's removed off my credit report? This was a huge burden on my credit report... The only thing I disputed is where they were located but not disputing the actual debt. But I will be writing a C&D letter ASAP to get them off my back.... isislc Posted July 23, 2007 Report Share Posted July 23, 2007 Also, check to make sure that the other CAs that had that account last are not still on your credit report. If they are, dispute them as to they are the same as the one from the attorney now.
