Hi there,

No, they can't just take your wages. They first need to sue you in court AND win a judgment. Than I hear it's a separate hearing to get the wage assignment action going. Were you EVER notified of a court hearing? Is it possible you avoided the notice? Either way, there are maneuvers they must first go through prior to garnishing. If you are unsure if you have a judgment contact your local courts and try to see if there's ANY records of the judgment under your name or theres...I'd try your own name first because typically these oxygen thieves sue so much that there'll be lists and lists to go through!

Well at least in GA, you are sent a notice of garnishment for a fed student loan prior to its commencement. This gives u an opportunity to request a hearing to stop it

In VA, my notice was when my emplorer sent me a notice saying they had a garnishment order of $400 per pay period! :shock:
