Husband spoke to Collection agency, can I still DV?

I want to kill my husband. He has been speaking to a collection agency on the phone about some past bills I have. Some are in the SOL, some are out of SOL. He was trying to set up a payment arrangement for $100 a month to cover the $1500. Then at the last minute, they say they can't do that, they are tired of us jerking them around, and the payment is due in full or they will sue.

Should I try to send a DV letter, or should I try to make payments anyway?

Not sure how to handle this since he has spoken to the collection agency.

BTW, we are in Mississippi, and yes, the business is in good standing.

I have another question on this situation as well. The CA told my husband that some of these debts are exempt from SOL because they are med bills from public hospital (state funded). Is this true?

Questions?

Are these reporting to the CRA's? If so you want to do a PFD upon payment. No PFD- No PIF. If they won't PFD, only do a SIF.

(settlement in full)

Can you pay them a substantial amount now or very soon?

Do you have credit cards to put this on?

Larger sums initially and then sending smaller payments may work.

Did you document the date, time, take notes and get the name of the agent? Is your state a 1 party record the calls state? ( many are- meaning you can record the calls) if OK, buy a recorder device to rack up the violations.

Are there any documented violations?

Sometimes sending in a payment stops legal action... always put an RE on all your checks to any CA. Better to have it on than not. It gives a reason to take action later if ness.

The only caution of DVing them is that it may just provoke them to sue immediatly, so caveats there.

Do you have assets or a steady job? If no assets and no steady job= less likely for them to sue.

So much to consider..... it's all about strategy.

We are both employed, but all of our stuff is financed so we dont' have alot of assets. The CA is already threatening to sue. About the only thing I can do is pay about $150 down and about $100 a month. My husband has taken a $17000 a year pay cut, so we are so tight.....and as it is, we have closed our CC accounts b/c we can't afford them anymore.

I got my green card back today in the mail. so the timer started ticking as of July 30. AFter the 30 days, if they can't provide correct info, then they have to stop, right? What if they try to pursue or sue?

Assuming you sent your DV within 30 days, they must stop immediately, and cannot attempt to collect until they send you validation.

They tried to contact us a while back, but never sent us anything when we asked them too. Then they started calling recently. My husband had several conversations with them.

Now here is where we are:

I sent the card last Friday(27th) I received the green card back yesterday. Today I received a computer generated bill on their letterhead. That was it. And it was only for part of what they say we owe them. So now how should I proceed? The 30 days isn't up, but they sent a bill--no validation information.
