wolfhound Posted July 29, 2007 Report Share Posted July 29, 2007 On May 24, my attorney filed the response to the NAF claim W&A had filed against me. He requested an in-person hearing, stated that the SOL has expired, etc. He called me a couple of weeks ago and said he recieved a notice from NAF saying they had entered an award against me. Shortly after he filed the response, he got a letter from them saying it was too soon to file the response and we needed to wait until proof of service had been given to them by W&A. Neither of us heard anything else from anybody until this notice of the award.He told me he'd write them a letter saying we would file a motion to vacate the award, they never contacted either of us until the notice of the award.Today I got a letter from W&A, telling me the NAF had issued the award against me, and telling me to contact their office to resolve it. The, of course they threaten to "evaluate" my account for judicial enforcement.I'll sedn a copy of this to my attorney and see what he thinks we should do about it. I know you had followed my case as well.. we were supposed to have an in person hearing but they did a preliminary one and as you can see by my post it went better then expected.You really cant do anything until you talk to your lawyer.. what I dont understand is why this came to you?? Why give up my case dragged on a believe me I wanted to end it by giving in but I knew they were wrong. You requested an in-person hearing, provided for under thier own rules.What happened with that? They just summarily blew youo off? That's a violation of your right to due process. So NAF itself and the arbitor in particular would both be targets of a civil rights violation case.They cannot engage in actions that would be binding as a court and NOT provide you with the due process rights your are entitled to under the constitution. private operation or not.When are these NAF cocksuckers gonna get RICO'd for these actions against thousands of consumers a year. They haven't been keen on following their own rules.And if W&A have committed a violation by contacting me directly, I hope we rip them a new one.
