How many FCRA violations???

My local credit union is reporting 25 total 30-day late payments between the 4 loans that I previously had with them on my TU credit report. All of the particulars about the loans are correct, but the late payments are completely inaccurate. (By the way 20 of the 30-day late payments being reported are prior to when the loans were even taken out). I disputed with TU, they verified.

I went into my local branch, spoke with the branch manager and gave her a copy of my TU credit report and pointed out that most of the late payments were prior to the "date opened" being reported. She agrees with me that there was obviously a problem with the information being reported. I tell her that I want an investigation. She takes my supporting documentation and tells me someone with contact me in a few days with the results. I wait 30 days and I receive no phone calls or written correspondence in this time.

I send a letter CMRR to the main office branch manager since that is where the people are located that respond to the CRA’s. I outline the situation with all the facts, point out how they had violated the FCRA and request that the erroneous late payments be removed. She calls me back the same day she receives the letter and leaves a message saying that it was TU’s fault and they had contacted them to fix the problem when I first requested the investigation.

It is now approaching 30 days since they received my letter and 60 days since I brought it to their attention. The inaccurate information with TU is still being reported. I’m preparing an ITS letter, but I’m confused about how many FCRA violations this would be. Would it be 4 violations because it was 4 tradelines they reported incorrectly or would it be 25 violations, 1 violation for each erroneous late payment being reported?

The branch manager that called and left a message told me that it was TU's fault and TU had to fix it. She made it pretty clear that they weren't going to take any further action. Also, she said that she was going on vacation and I could call her if I wanted when she returned. But that is not until next week. Just trying to get ITS letter ready.... just in case.

I'd dispute with TU - on phone or in writing - and give TU the name of the contact you have. TELL THEM TO CALL HER!!!! Demand that they don't use E-oscar to process your dispute - have them contact person-to-person. Highlight the "late payments" and the opening date in pink.

"Dear TU - How can you validate late payments on a loan BEFORE the loan was even opened? Delete these lates, you can verify the accuracy of my claims with the contact info of the lady at the branch I gave you, or I will proceed with litigation against you...blah blah blah"
