Recovering Attorney Posted August 2, 2007 Report Share Posted August 2, 2007 deny the allegations. for defenses, list: Statute of Frauds, Statute of Limittions, lack of legal standing, failure to state a cause of action against you, unjust enrichment.You may have a counterclaim back against them for unjust enrichment as neither Unifund or Palisades can chage you the contract default rate ( unless 19.99 is the post judgment rate in OH). If he is too far away (Cincy), see if knows anyone closer to you (although I'd pay extra for his travel to get him to defend me).Before you use the "I can't afford a lawyer excuse" remember that you can't afford a $5800 judgment on your report either.
