rebeccaj
I have visited the SOL page here and it states that Colorado Open Accounts SOL is 3 years. The Bud Hibbs website at http://www.budhibbs.com/statute_of_limitations.htm states that it is 6 years for open accounts.Through my web searches I've found it split almost 50/50 as to which it is.Is there one website or government agency that I could contact for the correct and accurate information? Should a call a local attorney? I'd like it to be 3...but my luck it's probably the 6!
IHateCAs
Colorado SOL doesn't recognize the term "open account" specifically.
IHateCAs
Looks like Colorado considers all contracts to be a 3 year SOL though.
IHateCAs
Although I bet collectors in Colorado sue under the "Liquidated debt and unliquidated determinable amount of money due" theory which is 6 years.
rebeccaj
Those sneaky CA's!Thanks for the info..I bet that's why there is differing info!
Amerikaner83
WA is the same way - 3 or 6 year SOL - depending on if someone defines a CC as a "written instrument"
