isislc Posted August 4, 2007 Report Share Posted August 4, 2007 Ok, here is my situation. There is an account on my CR that I know isn't mine. Apparently the charges took place some time in Feb of last year. Now I did a dispute and requested the billing statements and signature that it was my debt. Received today the statement of accounts but no signature. Reading through the statements a purchase was made of a kitchen nook, a table with benches that fits into a corner. It also showed 2 payments made on the account but it doesn't say how they were made, check, cc, etc. Now I know I didn't buy this kitchen nook from them. I actually went out and bought a kitchen nook from Hobo's a few months ago. Well, I was at my ex-sister-in-law's and just happened to go into the kitchen. Woe and behold she had this lovely kitchen nook just like mine. I said "Oh I didn't know you had one of these, how can you afford that?" Mind you, she is pregnant and has 4 kids. She said that she had it in storage since last year and decided to take it out when they moved. I immediately went online today today to see what this nook looked like that was supposedly ordered. Damned it was the same one in her kitchen. Well, I hate to say it but she HAS stolen from me before and she WAS convicted of fraud and identity theft from a Day Care she used to work at.Ok, long story short, when I fill out my affidavit do I have to say that I will assist in the prosecution? If it IS her, I don't want her to go to jail and the kids be tossed around in foster homes. How can I get around not implicating anyone? I don't know what to do. Help! As to the kids and foster care.........the state will first search for a relative for placement so if you are worried about them you can offer to take them in. As long as the relative asking for placement doesn't have any red flags (past criminal record, clean/appropriate living space, etc.) they will place with them.Personally I would file it on the basis that she has done this in the past, she has now done it to you, and she will most likely do it again to someone else. Although I admit it sure sounds like your ex-SIL did, let the cops prove it. Not your job.Your primary concern is to get his off your reports...beyond that, I'd say leave it alone. Some other information that I didn't include was that I had already reported this company to the FTC and Consumer Advocates. I received a letter today that after their investigation of the account that they concluded the account was fraudulently placed in my name! Now what is weird is that one of their other companies, I DID have an account with them and it was included in my BK. Now I got a 2nd letter from THAT company that they had investigated it and found it to be fraudulent also. They were going to immediately remove both accounts from my CRs. Now, since I DID own one of the accounts, it was included in my BK, and I NEVER said the 2nd account was not mine, should I call and correct them or should I leave sleeping dogs ly? After disputing as mine for a couple of months they finally just sent me the letters that they performed an investigation. Today I logged into my CR and had to call TC to verify it was me. The 3 CRAs even went and put a fraud alert on my CR and said to contact me at the phone number listed. Funny thing is, it's not the right phone number. Oh well, if it's actually ME asking for credit then they will have the REAL number and won't need to worry about the one on my CR.
