If they don't answer in 30 days, they are in violation. If they can't resolve in 30 days, they have to make the changes I requested.In addition, there were so many inaccuracies in the reporting it wasn't funny. They reported that I opened the account 01/01/1970 - before I was even born! Different balances to different agencies. Reported as an "open" "factoring company" account that was "120 days past due." Seems to me they only hire the worst of the scum on the Bud Hibbs website .I still have a 4 year wait til my debt goes past SOL. Until they hire someone that works within the posted federal and state laws, I will not work with them or any of their hired hit men.If by some miracle they hired a legit CA...I'd take the ding on my credit to pay it off. I had success with LVNV too, they folded like a cheap tent when I DVed them. Don't you know that must be a miserable place to work - not that I feel sorry for them or anything! I sent them a combo "nut case" /DV/no phone calls letter in June because they are out of SOL and reference LVNV and Resurgents and told them I was going to sue them for all violations if they didn't get off my report. By the 2nd week of July Both LVNV accounts (one was a duplicate entry) dropped off my reports. Now I keep getting dialer calls and when I looked up the number it belongs to Resurgents. My situation is a bit different because there is nothing on anyone of my CRs showing this amount or any of the string of companies they list associated with it (however if they could be reporting and it might not be showing yet). I think this is an amount for a CC that I had at least 8 years ago. Could you provide me with the letter you sent them? I am going to DV them but dont want it showing on my CR for investigating/DVing. I would like to find out a) exactly who the OC was on this amount, make sure that it doesnt show back up on my CR and c) that I dont have to pay them because it is past the 7 year mark. brokemommy Posted September 1, 2007 Report Share Posted September 1, 2007 I would send them a regular DV first since you are not sure who the original creditor is, and just to make sure you are out of SOL. I think the SOL for IL is 5 yrs on credit cards. It's only 3 here in NC, and I knew the debt they were trying to collect on was definately not mine and they were reporting it twice. I've been fighting with LVNV over this for awhile. I'll be happy to post the letter, but I'm not sure it's appropriate for your situation. It was sent CMRR. I will DV CMS and see what happens. Obviously they don't know who the OC is because they state on my letter "Previous Creditor: OSI/Gulf State Credit-original creditor". didi56 Posted September 2, 2007 Report Share Posted September 2, 2007 I too have a problem but mine is with unifund. they have me down as having a installment loan with them opened 11/05 last activity 12/05 installment loan one month term and in payment history shows I made a payment in 06 then 2 payments in 07 now 120 days past due. false false false I disputed with cra, they came back updated with citi as original creditor. that was it .still shows them as me taking out a loan with them and a payment history. The amount they are trying to collect is much higher than the old credit card I once had. The debt amount is reported differently on all three credit reports. They haven't sent me any credit card statement copies. They have not told me what part of the amount is interest and/or fees.
