my3girls Posted August 31, 2007 Report Share Posted August 31, 2007 o.k. a local collector heard i had lunch w/her husband. #1 not true, he happend to be in the same place as myself & a friend. #2 she's extremely jealous, so jealous, that we say hi and thats IT! #3. i have been making pymts on accts at her place of employment (which is a law firm/collection agency) not been late!all of a sudden he calls me and says she told him and some friends about my accts there, SLANDERED ME RIDICULOUSLY!!! to him and friends. Next thing guess what? all of all sudden the accts i have been making payments on have been pulled and a lawsuit filed against me, needless to say i had to borrow the $ to pay in full to keep from going to court!by the way she is the accts. supervisor. My ? is there ANYTHING THAT CAN BE DONE?????????????!!!!!!!!!!!!! I"M FURIOUS!!!! She did this on purpose to be malicious and embarrass me!!somebody help please , i called and talked to her boss about this ,his reply well was it true and exactly how did she embarass you? needless to say, i hung up of coarse he's going to defend her actions! i didn't think she could reveal my info outside? hiblues Posted August 31, 2007 Report Share Posted August 31, 2007 Read the FDCPA.link at the top of this page...its a violation of the FDCPA for a CA to disclose debt information to 3rd parties...you'll want to counter sue.Can you get notarized affidavits from the 3rd parties? (get it now before memories fade.)get very specific details of what she said about your debts!You'll also want to register complaints with the FTC, the State AG and the State BBB.How much is the debt? This persons own husband was trying to get her in legal trouble?If she did it, she was wrong and can be sued. It seems odd though that your witness is her own husband. Why would he do this to her? I was heading to her office furious, he calls me begssssss me to please not say anything to get her fired! I promise i won't (he works w/the police dept. an investigator) AS LONG AS SHE DOESN"T DO ANYTHING ELSE!!!! he says he'll handle it i won't hear anything else out of her~! jasen Posted September 5, 2007 Report Share Posted September 5, 2007 It sounds unlikely you'll get any affidavit out of him, short of a subpeona (and even then, I know I'd commit perjury for my wife), so maybe see if you can find out who else she talked about you with and see if they'll sign something?Best case scenario, you make $1000 from her company (just counting FDCPA damages, not the slander), and she gets fired. Communication in connection with debt collection [15 USC 1692c] ( COMMUNICATION WITH THIRD PARTIES. Except as provided in section 804, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than a consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.
