Lilolas Posted September 6, 2007 Report Share Posted September 6, 2007 Hey everyone,With the incredible information on this site, I have been able to successfully get about 8 negative items deleted from my credit reports. Just as I was beginning to celebrate, I found a new negative item on my reports from Asset management. The original "debt" was with Bally's. About 3 years ago I signed up for a membership with Bally's and after 1 year I canceled the membership. This was being listed as an account in "good standing"...but now it's a negative listing with this collection agency; stating that I owe $466. I've already asked that the CRA's to investigate. TU is still working on the investigation and Experian said that this account was "validated". Besides sending out the DV letter to Asset, what should I be doing now? Does it matter that I have never received a statement from Bally's or Asset regarding this negative information?THX! Link to comment Share on other sites More sharing options...

You need to to know the who, what, when and how the debt was verified. I am sssuming you contact the CRA's first before sending your DV to the CA. Remember that CA's do not have to respond to your DV. They must, however, verify with you before they can verify with the CRA's. isislc Posted September 6, 2007 Report Share Posted September 6, 2007 Heh, the only reason Bally's is trying to collect any debts now is because a Lot of people started cancelling their memberships when they started hearing the rumors of them going BK. They are still planning on going BK and guess what is happening to all the paid memberships? I wouldn't be too surprised if you have a membership and you find your gym locked in the near future. But, you still have to pay the life of the membership I'm told. Got this from a family member that is close to the top and directly involved. I did a little investigation concerning Bally's financial picture...and let's say it doesn't look good for them. I think this could actually be a good thing for me (and other's out there battling them). Let's hope anyways!!Thanks everyone for the advice! When I returned i stopped going regularly and noticed that they weren't debiting from my checking account anymorexdancex ...i just kind of assumed that they forgot to take me off the "leave of absence"....guess they've been doing some house cleaning lately:roll: Thx for your encouragement! txtrouble Posted September 9, 2007 Report Share Posted September 9, 2007 Lilolas - The only other loophole besides the 20 miles from a gym thing is a disability or injury. I had a contract/membership with Bally's a few years ago and had a bad back injury. I cancelled my membership based on this. I got a letter from my doc, called them up telling them what was going on, and if I remember correctly, faxed in the letter. They did cancel it and I got a refund of some sort too even. I think they amortize the contract and if you weren't "upside down" you got some sort of refund. It wasn't a complete refund and not very much, probably around $100 or so. So not sure if you have a medical issue that might prevent you from partaking in Bally's services.They did try to get me to do a "leave of absence" instead which I refused. They wanted me to put my membership on hold for 6 months to see if I got better. I simply told them as per the contract, if I become injured or for any medical reason that prevents me from using the facility I have the right to cancel my membership. Asset Management is back with a vengeance So I DV'd them for a 3rd time (this is after numerous disputes with the EX (they are only reporting to EX); and I get a dunning letter on Friday (9/21) stating "WELCOME TO ASSET" making no mention of the 3 DV letters I sent out...then on Saturday I get their validation attempt. It is printed on their letterhead of course, the amount owed, name of OC, OC account number, my address and partial SS#.I'm so mad I could spit...they have numerous violations from reporting to EX w/o validating with me...and then sending me the dunning letter before they validated the debt...any suggestions?Do I send them a letter requesting further validation? Do I send letters to the BBB, AG, with the violations I do have on them? Do I just settle and put my efforts on getting a PFD?
