msteve0000
Hello,I want to thank all who helped me vacate several judgements in New York(especially Recovering Attorney). I have settled these debts for very little money. I even had written in the stipulation for Creditors to report deletions on all accounts to CB's. Thanks. One last account--I have this judgement from an AT&T/Palisades account which has inflated to $2700. Original debt was $1600. However, I have always disputed this account with AT&T. They claim I had a second phone and rang up these charges. I don't remember a second phone. I have an Order To Show Cause To Vacate. The plaintiff is taking a hard stand with this one. I'm sure we'll be going to trial. My question is what other motion can I file to dispute the original OC debt. Countersue? Not sure how to handle this one. Thanks,MS
charlanyc
After the judgment is vacated, you file your answer with the court. Your answer should include your counterclaim and defenses.

One question-- once my judgement is vacated, must I have my answer, counterclaim, and defenses prepared during these precedings, or for the trial judge? Thanks

One question-- once my judgement is vacated, must I have my answer, counterclaim, and defenses prepared during these precedings, or for the trial judge?ThanksThey must be filed after the judgment is vacated and then discussed at trial.I had to file my answer before my order to vacate was completed. (I've heard different stories in the Bx and Queens) I used the "Answer In person" form but if I'd known better, I would have had an answer prepared and then attached it to the "Answer In person" form. What happened when you had the other 2 judgments vacated? msteve0000
Hello,After the judgements were vacated, the judge asked us to work it out before trial. We settled for 25% of the original debt. However, on this judgement, the plaintiff attorney wants the full amount.MS
