NY tolling provisions ?

Anyone familiar with New York Tolling Provisions, on stopping the clock on an outstanding debt ??

Since Portfolio Recovery is reporting a $100.00 payment, which isn't so, and suspect they are doing this to toll - stop the clock...

I went to the VA OCA site, they only have a standard complaint for download to be mailed in, is this the way you did it, I know I can call, but, would like to also show them all the documentation I have regarding Portfolio Recovery, including their latest trade line, so What's the best way, write and address it to

Joe Boisineau, or just call and try and make contact with him?

Most only have one form to submit, and reference that you may add seperate pages also. Do download and submit your complaint, and, most definitely, include all info you have to support your claim. On the envelope, you could note "ATTN: Joe Boisineau" to the lower left of main address. The letter will be given to him directly.

What they have done is called "reaging", not tolling. To toll, you must have left the state for a period of time, and returned. At that time, they can bring it to court and ask the claim be tolled.

Thanks for the advice, Reaged ? how can I prove that?, or is what I have to submit proof enough to show it was Reaged ? anyway of elaborating on this so I know what exactly I will write in the report ? I can only assume they claiming a $100.00 payment being the way to re-age it ?

As to reaging, you say they are reporting you made a payment. You say you didn't. You would want to cause them to prove you did. For example, they say by check. If so, many times they note the check number in the file as well as the date received. No problem, your bank can supply the info, or, you can, if you have all statements for that period of time. If they claim by MO, you would have to have them give you the info used on their deposit slip as I'm fairly sure they only note the deposit info and not the name of the MO company. Then, you would use that to locate and trace the MO. Yes, it is a charge of usually $8.00 to do this with the MO companies.

Either way, your goal is to force them to prove their claim. Yes, if you have a TL from the OC, it would also help you in time frames. Or, for that fact, anything else you may have to disprove their claim.
