It has some years later and now a collection agency/law firm has filed suit against her claiming she owes them the amount of the credit card balance. analog_kid Posted October 24, 2007 Report Share Posted October 24, 2007 Have they actually filed suit against her or have just claimed they will "unless"? I'm going through a similar situation. They can sue, but chances are they just want to see if they can get the money out of you. Have you sent a DV? That should be your first step. Also, check your credit report and see what that says. If the account was indeed "purchased by another lender" than you are probably dealing with a JDB, in which case, they will say just about anything to get some $$$$ out of you. How can they do this without no represenation from the bank?There are many occasions when a credit card company will "charge off" a debt which is what they do for accounting purposes. There are junk debt buyers who buy these debts for pennies on the dollar and contact you for payment. If the debt is still within the statue of limitations, they can sue. The first thing you need to do is get your most current credit reports. If you have not gotten for free ones for this year, you need to do that right away. You can send them a debt validation letter whereby they must prove they own the debt. They do not necessary have to prove it to you but they cannot verify it with the credit bureaus if they have not done so with you. There are sample letters on this forum.
